B2 Visa, Homeland Security: to those Filipina married to American living outside USA

Hi Everyone,

I am a Filipina, married to an American citizen. We got married in the Philippines in 2009. We are currently living in Korea and are going to visit the US soon. I already got my B-2 visa (valid for 10 years). We are about to visit the US, but have been told that I might be denied entry in the US since B-2 visas are not usually issued to spouses of American citizens. We were told to file the I-130. We would do so if we had plans to eventually move to the US, but right now, we do not. What are my chances of getting through Homeland Security? Also, can we file for a K-3 visa while we are living in Korea? My husband is not military.

K3 is no longer processed, you would need to look at CR-1/IR-1 and DCF you can file through DCF in Korea if you meet their guidelines.

Is your husband in the Military? If so then you can file DCF and use the CR-1 to enter. When you return to Korea accompanying him it wouldn't be counted as time outside of the US since you're accompanying a US Service member.

It is perfectly fine to use a visitor visa to visit the US, your marital status notwithstanding. Anyone who told you spouses of US Citizens cannot get tourist visas for the purpose of visiting is wrong. You can, and did. Be honest at POE, and you're fine (you're also traveling with a husband who does not currently reside in US, sounds good).

I just applied online for a B-2 visa also for my fincee who lives in the Philippines. I wonder how long it takes to hear anything back from them? I hope she has no trouble being approved. I filled out the app and told them I was paying for trip and everything. I am hoping that speeds it up. My plan is she will come here for 6-8 weeks then we are both going back to pi and I am going to live there.

You do realize that having a Fiance in the US weakens her "Strong Ties" to the Philippines, right?

Unless she has children, awesome job, owns property and/or has a lot of money in the bank it will be difficult for her to get approved for a B-Class Visa.

Yep that actually weakens her case not strenghten it.

It shows she has no ties in Philip - you are paying for all the expense for the trip from US shows her fianacial condition is not that great.

Which means if CO grants her B2 what are gurantees that she would return back to Philip.

She has 4 kids and has about 200k peso bank account. I hope she doesnt have any trouble.

I know the tourist visa's are getting tough. My wife has a 23 year old daughter in the Philippines. She has a great job (5 years with an American company), Owns a condo free and clear in Las Pinas, and a good bank account.

The US Embassy in Manila refused her tourist visa to attend our wedding in the states. I provided a letter of guarantee that I would personally be responsible for her airfare, and all expenses in the states. I had a letter from our minister providing the date of the wedding. My step daughter was going to be our maid of honor. The interview lady never even looked at the documentation we sent. She just said that my step daughters ties in the states were too strong and that she probably would not come back to the Philippines.

Perhaps the 4 kids but the bank account is not very solid. I know of someone who has more than that in the bank plus properties and a business but was denied 2 times, the reason was not enough ties. I am not discouraging you, but the fact is, it is very difficult to obtain a B visa especially when you're from the Philippines.

Like the replies before mine, it will be more difficult knowing that you are her fiance and you'll be spending for her.

But you can always try, you'll never know.
