i-130 sent back to USCIS

okay anyone that has experience with their case being sent back to uscis, i would like to know how long it took for you to get your second interview after your case was reverified (if thats a word lol)?

i had my first visa interview july 29,2010. my visa was denied and the interviewer said that she is sending my case back to uscis because it needs to be "verified"

the embassy sent my file back to uscis in early august. uscis sent a letter saying they have received my file in october. nov. 17th, they asked for supporting documents to be sent to them. they gave us 30 days to send the documents to them. ok, so now i would like to know what is the next step. how long does it take for them to look at my supporting documents to give me an answer?

any help on this would be appreciated and if you have any questions about specific details of my case that would help you answer my question better, feel free to ask. i would be happy to answer.:)

First of all... What was the reason your visa was denied?

Normaly When USCIS send a case to any embassy it is because has being approved, that's means that the case has all requeriment documents.

What did they told you? What documents do they ask you for??

The time depends on what kind of relative category you're applying for...

What type of Visa was denied?

If you sent the supporting documents already, they will look at it and make a decision. No one can tell you how long that will be. However, if your supporting documents were strong enough , they will reaffirm your petition and send it back to NVC, and then scheduling interview again.

i applied for an IR2 visa

this is the reason the interviewer wrote on the denial letter

"Petition is being returned to USCIS for reconsideration.Please send all inquiries and correspondence to USCIS and reference your original petition number.You will be contacted by this office when USCIS has made a final decision."

How long (years) has it been since you left America?

You may still be within the ban period.

11/9/2010 : Acceptance email and text message received & case transfered to Vermont Service Center

11/13/2010: NOA1 received, now the wait begins....

11/16/2010: Case touched

01/04/2011: I130 Approved ! 57 days.

How could you leave out this very important fact? Of course, it affected the petition for you. Did you think you could benefit from the immigration laws when you violated by living illegally in the US?

These are the rules about illegal presence in the US. Days are only counted after your 18th birthday.

If you lived in the US illegally for more than 180 days and less than 1 year before leaving the US, you are subject to a 3 years ban. If you lived in the US illegally for more than 1 year before leaving the US, you are subject to a 10 years ban.

If you are under a 3/10 years ban, the US Embassy/Consulate MUST DENY your visa application.

It's very likely that your case was sent back so your illegal presence in the US can be investigated.

okay i just wanna say that i left the U.S. when i was 17 because i knew about the ban

and i got my illegal stay pardoned by the U.S. and i gaive this document to the US Embassy and another copy was sent to them by the official that signed the waiver pardoning me.

i was in the U.S. from age 6 to age 17

had a voluntary departure at age 11 but my family decided to keep me in the u.s. because i was the only one without papers and had hope that maybe my case could be resolved in the u.s.

but i still feel like the embassy sees the fact that i lived in the u.s. that long without papers and they see it as a reason to make me wait longer and punish me in a way, even though i got the waiver for my illegal stay which should mean everythings okay. and even though i was only a kid.
