Hi guys,

So we had our Infopass appointment today in Charlotte. They were very nice, polite, compassionate and helpful. We asked if he could make sure our RFE was resent - he said wait guys, I will call Missouri, come back in 60 minutes.

So I came back (hubbie's lunch break was over) and he handed me a fax of the RFE from Missouri. He said they sometimes don't send them a 2nd time and it is better to get the fax. That was so nice! Also, the typo of my name wasn't corrected yet. I called 3 weeks ago concerning that typo. He made sure it is corrected now, also they put our address wrong in their system, but only for the RFE!!! He corrected that also. He sent 2 faxes because of that and called them to make sure everything is fine. He also called them again and faxed a notice that my AP is important - he did so much, it is unbelievable. He stayed on the line for so long until he found somebody to do something!!!

But he recommended me to come back in November for emergency AP if I don't get it by November 1st.

Now, the RFE: of course affidavit of support. So he explained to me: your hubbie has to sent in a letter which explains that he was a student and a notarized employer letter.... I said that is exactly what we sent. He said sometimes things get lost on their way from CHicago to Missouri, just resent it. I asked him if it would be safer to have a co-sponsor, he said we can do it, but we actually don't have to. Anyway, mother in law is preparing that stuff right now and express mails it tomorrow, so that on Thursday we can sent off the answer right away.

Puhh! What a day! The only stupid thing is that they stated on the RFE that they think initial evidence was missing. There is a sentence: " You are ineligible for EAD until 90 days after we received the initial evidence". Does that mean I won't be able to work this year, even though we sent that ####### in in July???? That sucks BIG time. Or is it just a statement and people get the EAD still in time (which means 90 days after July 28th when we sent in our AOS package)????

I think, technically, the statement on the RFE letter is what they intend, that the clock is reset after you send in the RFE. But it seems that they don't follow their own policy. My husband had no trouble getting the interim EAD after 90 days from the original receipt. They didn't even seem to know that there had been an RFE.

I don't think the 90 day clock is reset when you get an RFE, just paused. But I could be wrong.

Good to hear of a positive InfoPass experience :D

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.

I don't think your wrong, but the wording makes it sound like you are! "You are ineligible for EAD until 90 days after we received the initial evidence". Clearly they're ignoring that rule. Good, its stupid. :)

I guess, like with anything USCIS, it's open to the interpretation of whoever feels like answering it - including differing interpretations by USCIS!

I hope that they will ignore that rule. It's stupid anyway...

Oh well, my mother in law just mailed us the joint sponsor stuff. Since she is self employed and highly organized she had all that stuff handy. Paul filled out everything again and gets it notarized tomorrow, so we can send it off on Wednesday!!!

But I have to admit I am still stunned how nice the officer here in Charlotte was. He was really interested, I can't believe it. Didn't expect that!!!! I can just recommend their office....
