USCIS is at it again!

Well, here we go again with the USCIS. I submitted an I-130 for my wife's son. The NOA1 date was July 24 I think. The file ended up in California. Then, mysteriously they transferred the file to Texas in early November, supposedly to speed up processing. I'm sure they never touched the file at the CSC so that time was lost. Then in late November I get an email saying the State Dept. has asked the USCIS to review the case. But the kicker is a HUGE number of other filers, especially CR-1 filers, are all in the exact same boat. There's a 300 page thread on this mess in the CR-1 forum. People are going nuts. And no one's getting their NOA2s from Texas.

Apparently after the Texas transfers the "Decision Phase" was jumped over to the "Post Decision Activity" phase and nothing is getting done. Some say it's a gross USCIS error. There are lots of theories but the USCIS owns nothing. My wife's son's file has not been touched since November. We're now close to the 6 month time frame so I guess I'll call the USCIS but a million people have called and everyone get's a different answer. In the meantime, people who filed in September are getting approvals. Its the bureaucracy at its worst. Again, this is not just a few cases, or I'd think this was some kind of AR issue...but we're talking tons of filers.

I hate the USCIS...just such idiots. I went through this sh!t with my wife's filing. I guess Obama hasn't improved things at Homeland Security.

My only concern is my wife's son turns 21 next September and with the snail's pace processing and rumors it takes 6 months to get an interview after NOA2, I'm starting to worry he may clock out before this crappola get's handled.

I was wondering if anyone on this forum is caught up in this latest USCIS soap opera?

i personally freakin' hate the TSC. it really sucks big time that people who filed after u gets approved before you, called them they said it shouldn't take this long for our NOA2 my priority date is July 27 and NOA1 aug.16, all they said is that to call them again exactly 61 days after the last letter we got from them w/c was Nov 24 when they said the dept.state blah blah blah needs review blah blah. .and then after that freakin 61 days that's when they can submit a request to look into my file because it's past the processing timeline. .. anyway, you're right it's bureaucracy. . .

AOS RFE :(co-sponsor proof of citizenship) : April 23,2011

RFE sent : April 25, 2011 (overnight)

DS230 RFE : April 26, 2011

RFE sent : April 28, 2011 (via FedEx) NVC received May 2, 2011

SIF : May 13, 2011 (US time) May 14 (here in the Philippines)

Case Close : May 16, 2011

Medical at St. Lukes : May 17, 2011 1st Day

May 19, 2011 Immunization and got the CD xray :)

Interview : July 12, 2011 (6:30 am) yiipppeeeee

INTERVIEW RESULT : APPROVED!!!! :)

VISA ON HAND : July 15, 2011

these are painful times... i have gone through so much filing and waiting and paper work.. it seems that productivity at all the processing centers is very low..i believe they give preferences to non-citzens than citizens..

its just hard to believe that even if they do that, the overall filing of H1B visas has dropped significantly. So where is the work getting generated from at these processing centers???

why is the process so slow and not helping people who have legally been in the united states.

TSC seems to be processing stuff very slowly... wait and watch what happens next. the only thing you can try to do is to call your congressman and senetor and explain the situation. but they wont help much if the case is within the timeline.

hope things get resolved.

December 18th 2007 - Left for india to see fiancee

Jan 1st 2008 - Engaged!!!!!!

Jan 15th 2008 - Biometrics Fingerprinted

June 4th 2008 - NOA 1 Received

July 3rd 2008 - Touched

September 6th 2008 - Left for France.

September 23rd 2008 - NOA2 Received

September 27th 2008 - Will leave for Malaysia from paris.

September 28th 2008 - Will meet fiance after 261 days!!!!!!!!!!!!

October 18th 2008 - Will return back to the US after spending 3 weeks with fiancee.

Dec 28th 2008 - Fiancee Visa approved

Jan 1st 2009 - Fiancee landed on US Soil

Jan 6th 2009 - Married

Jan 30th 2009 - Filed for AOS

May 31st 2009 - AOS Approved

NOA1 - Received on June 4th 2008

I was wondering if anyone on this forum is caught up in this latest USCIS soap opera?

Did the State Department ask on your behalf for the USCIS to review your case quickly because of his age, or did they just generate a random inquiry? If there is a red flag in the case there is really no predicting a time line based on other cases. If State put some kind of marker in the file, its going a different route than a typical file does.

FYI, Texas sucks at N-400 petitions as well, Arizona is moving at a like the hare to Texas' tortoise. . .We filed at Texas in October and December Arizona petitions are getting interviews. . .

No longer in the hands of the USCIS, for my wife at least, next up MIL.
