Question on the above listed form.

Filed my last 3 years tax returns from Thailand. Have been married to a Thai national during that period of time and have filed my tax returns as single.

I have requested a transcript of 2009 tax return from US IRS to attach to the listed form.

Is it going to cause a problem showing single, when all the other forms show I have been married for over 3 years even though she is not a US Taxpayer and we have lived outside the US?

You should not have filed your tax returns as single. You weren't single.

This may be problematic for you because you will have to submit your tax returns with the I-864.

Talk to an immigration lawyer. Amend your tax returns.

I agree with JO jo why did you file as single when you were married? You will have to amend this big time. Did you do 2010 as single too?

Haven't been able to file 2010 as of yet as my 1099's have not become available.

Yes, I plan to file as "married" now that I'm back in the US and will be starting employment soon.

I guess I made a mistake filing as single. Figured that I was not living in the US for several years..married in Thailand to a non US citizen and didn't figure it would matter.

I didn't file at all when I lived in Thailand. When I came back I filed as Single and ended up owing the IRS about $10k. Once my wife was here with an SS#, I went back and amended 3 years of returns. The IRS wiped my debt clean and ended up owing me $5k because I amended them married filing jointly.

Done for 3 years or 10 years. Haven't decided yet.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
