Hi all

My fiance is a u.s citizen. I am a Nri also. We are getting married after 3 months.

I want complete details for k-3 what to do???? as i understand DCF visa will nt b possible for us due to changes in rules.

I want the detail right from the day we get married? What to Do next?

nd how many days it will take?? When i can apply visa?

All things step by step

Can anyone give tell things in detail???

Further, any case where both lived outside from India. Please share your experiences.........

Click on the 'Guides' tab above. You will find a lot of helpful information as well as step-by-step instructions for whatever you decide to do. Keep in mind that it is the US Citizen (USC) who has to do all the filing.

As for both of you living abroad, I think that the USC would file at the American Embassy in the country she is currently in. You will have to go back to India to do your part...I think this question was previously answered here.

No one will be able to give you an exact time of how long it will take. I have been looking at timelines of VJ members and the average time is around 6-8 months. You should also check the 'Processing Times' link above.

If you are abroad.. and wanting to get married you will need to look at whether or not the country you are in will allow non-residents to marry and if you do marry .. can you then file a DCF (I130) direct from embassy there.

If i am reading your last question correctly. you asked if you can file from another country where married or does it have to be in India? From what I understand you file I-130 in the country where married.

But for K-3 is that the same? I believe you will need to return to your country or residence to await processing. But if you are in a country as a resident I.. in France.. living there set up residency.. you can marry there once the marriage time frame is established.. some countries only allow non residents to marry after certain criteria is attained.

Best thing to do is look at the country you are thinking of being at.. some wont let non residents file for I-130 (DCF)

US Embassy link look here for the country you think you will be at. find the country look up visa rules look for rules for IR (Immediate Relatives) if the country you are looking at allows non residents to file it will say how to do

Look at what it says for Belgium:

"Applicants for family-sponsored immigrant visas who believe they are entitled to immigrant status based on a relationship to a U.S. citizen or lawful resident alien should request that relative to file a petition (Form I-130) with the nearest office of the U.S. Citizenship and Immigration Services (USCIS) in the United States. In some cases if the U.S. citizen sponsor is residing abroad, he or she may file the petition with the Immigration Service officer or a U.S. consular officer at an American Embassy or Consulate. "

"U.S. citizens who wish to apply for an immigrant visa for an immediate relative (spouse, child or parent) may file an I-130 immigrant visa petition at the Immigrant Visa Section of the U.S. Embassy in Brussels. Both the petitioner (the U.S. citizen) and the beneficiary (the immediate relative) need to come in person to the Embassy any working day between 2:00 and 3:00 P.M. No appointment is necessary.

You need to submit the following documents:

For the petitioner, your valid U.S. passport, naturalization certificate or birth certificate; for the beneficiary, the valid passport

Documents proving your relationship:

if you are filing for a spouse, the original marriage certificate

if you are filing for a child, the child's original birth certificate

if you are filing for a parent, your birth certificate and proof of U.S. nationality if you were not born in the United States

A divorce decree or death certificate to prove termination of any previous marriage on your or your spouse's side

One color photograph for the petitioner and the beneficiary

An application fee of $190.00 per application payable in USD or euros in cash or with credit card (Visa, American Express, Master Card, Discover)

proof that the petitioner or beneficiary are legally residing in Belgium, e.g., identity or residence card "

Dont know if that helps at all.. if you are able to legally reside in another country... you may wish to think of this process. In Belgium the DCF L-130 filing takes 4-6 weeks. check on where you are thinking of but only if you have legality ligit reasons to be there to file.. if you are just looking to be in a country.. as a short cut .. many countries will not allow that processing and frown upon that as a way of shorcutting the process. However if you are residing outside India and have residence status you wont have to return to India but simply apply in the country you are residing and thus making it possibly a bit faster in the duration of the process .

thanks for your information. But we are getting married in india only. As right now im working in africa nd this visa is called resident permit.

so i dont know whether i should do interview process in india or aborad where im living for 2-3 years.

if u know something, please let me know abt this.

hey man..........if you are in africa and working their.......so are you planning to leave your job and stay in india till you get interview?????????????????????? if not and want to continue doing your present job then how can you do you interview procedures in india.........and one suggestion for you..........if you are going back from that country then get the clearance certificate the usa govt wants ok dear........that is the police clearance certificate.......for all those time periods which you have stayed in a place for more than 6 months after your 16th birthday...........since you are both NRI's so i think money is not problem .............so best thing i suggest is to hire a good attorny in usa and get all required information before doing anything ok .....and by my experiece you will have to wait in india also to register the marriage with the registrar.......that is minimum 30 days after submitting application with the registrar of your native place......and that requires your name in ration card etc so all in all get help from good attorneys in usa as well as people dealing in immigration in india also.......before you even take the first step..........as i went all through this...and its tough out their....i am from bhopal.........

If the marriage took place outside the USA the K3 visa interview will be held in the country where the marriage took place (or at the IV post that serves that country if there is no IV unit in the country).

If the marriage took place in the USA the K3 interview will be held in the visa applicant's country of residence (with the same exception as above.)
