QUESTION:US CITIZEN WANT TO FILE I130 TO SPONSOR CHILDREN

HI,

My dad is us citizen and he wants to apply for kids over 21 married and unmarried what document he need to file wid I 130.

my understanding is that he need to fill

I130 form

kids birth certificate in english and native language

dads nutralization certificate

fee $420 for each

what else he need to send along wid I 130?

plz reply.

2nd question i want to ask that

my mom just passed and my dad is widow, he never married after that. been married only once wid my mom and she passed

on I 130 it say marital status? it will be widow right?

then it ask

date of present marriage if married?

what should be the answer?

is the gonna be N/A

or

date of marriage that he had ?

plz help

i checked the link u send thanks. i am confused what we have to attach for my widower dad?

death certificate of my mom or marriage certificate?

do we need to send any passport style pictures of all the kids with every I13o

if he is widower means he dont have to mention any date of marriage at all? even if he was married wid my deceased mom

Copy of death cert will show marital status.

No passport photos for I-130 petition for any case other than a Spousal visa.

I do not believe any marriage date need to be noted, he is no longer considered to be married..

ok thanks.

i got all the following documents

I13o for each child

birth certificate of each child in english and native language

naturalization certificate of my dad

fee of $420 for each child

death certificate of my mom

and i can send these documents together for all kids in same package but for every i130 i am gonna attaach all documents and fee seperate stapled.

am i right?

Yes can send together, however treat each like they are individual, no sharing of things like the death cert..

Also NO staples, use paperclips

One more item from the guides, if death cert does not name father as widower, then copy of prior marriage cert should be attached to show that a marital relationship had existed.

if i just send my mothers death certifiate that shows her name and it says wife of ---- and i dont send their marriage certificate but uscis need it and they need more proof are they send as letter saying they need more proof?

just so u know my mom been into immigration process before. she got her immigrant visa wid me when my dad applied for me and her and i was under 21. bec she got sick she wasn't able to travel at all and her visa got expired. so my mom is already in their record that she is my dad's wife and my dad been married to her. is that gonna matter?

on I 130 where in the end it says

did u ever applied for any other relative before and what was date of filing and what was result?

i mentioned abt my mom and my name becuase we been into immigration through our dad.

is all that matter?

Now that I have more details.. Are your siblings, your father's biological children, or step children.. And If step children, how old were they when your parents married. This is important and can be a deal breaker, a US Citizen cannot petition for step-children if the marriage that established the step parent relationship happened after 18th birthday...

If the case is father is step-parent after 18th birthday, then YOU will have to file petitions for your siblings, and can only do this after becoming a US Citizen yourself.

no they are biological children. they are not step.

i am the youngest one in the family.

in the past my dad only applied for me and my mom (not my other over 21 brother sisters) when i was under 21 to make the process faster. we got visa in very short time we didn't had to wait as he was citizen and i was also under 21.

they are my real brother sisters. my dad biological kids.
