ok just for even more peace of mind. i've just called customs here at st thomas and she said, all i need is a valid passport, visa and i-94. and i have all of that. so no worries there :).

thanx again... i got my reassurance regarding the getting married part tho. so maybe i'll go outside for a bit and try to relax :)...

happy foruming, i'll keep everyone posted once the preverbial ball starts a rollin'...

If you're sending the AOS package the day before your I-94 expires then it's pretty certain it won't be officially accepted by USCIS before your I-94 expires. You'll probably have at least a few days of overstay. This won't affect your AOS process at all, but it will mean that your B2 visa is canceled. You won't be able to use it again to return to the US if the AOS happens to be denied.

You don't have to prove you didn't intend to immigrate. It's the other way around. USCIS would have to prove that you DID intend to immigrate when you entered. Further, if that ended up being the only negative factor they had against you then it's highly unlikely they'd deny your AOS for it, though it might prompt them to look deeper for a more serious reason to deny it.

Do you have to pass through immigration returning from St. John? I ask because if you only have a little time left on your I-94 then CBP might refuse to admit you unless you can prove without a doubt that you'll leave again before the I-94 expires. That would be tough to do since you don't intend to leave again.

thanks that makes me feel heaps better :)... i actually just got off the phone with customs and they said all i need is a valid passport, visa and i-94 to get thru and, like i said, i have a return flight home if they need more proof that i'm not gonna stay...

Seems like you have everything planned, and it *should* go well. However, be prepared that sometimes you get a "doos" at the border, and your plans might be ruined.

Wish you luck though!! It will be nice to have another South African around :)

Seems like you have everything planned, and it *should* go well. However, be prepared that sometimes you get a "doos" at the border, and your plans might be ruined.

Wish you luck though!! It will be nice to have another South African around :)

lol @ doos... i really miss speaking s'african sometimes. trying to teach my fiance afrikaans but he only knows the rude words hahaha.

thanks i'll keep everyone posted as to how it goes! who knows, maybe i'll be home sooner than planned if there is a "doos"... :)

First of all your thread is too long and im so lazy to read it all now if you want to take a risk go for it at least everybody are given 180 days grace period to come up with your filing of AOS.

If you are too lazy to read it all then perhaps you shouldn't comment. Perhaps you shouldn't further comment if you are not 100% sure you are correct...and judging from your response you are not.

You ALWAYS ALWAYS run a risk of getting in trouble on an overstay. Not one single person on this forum can say "it's ok" and be 100% correct. What they can say is "You SHOULD be OK", but that it doesn't mean you won't get hassled.

It sounds like the original poster is doing everything possible to cover herself and her husband, so I will cross my figners for them and hope for the best!

did the dr's app today (4 needles! ouch). going back on sunday for results. also got the licence. all i gotta do now is find a jp to do the marrying...
