Hello everyone,

My Mom filed for my brother and his approved petition is at NVC and we are in process of complete his AOS.

My mom doesnt work and she has no income and she live with me, I will be submitting AOS with her for my brother. My question are

1: My mom has no income and she will still send I1864?

2: I belive I will also I864 ? or do I need to submit I864A?

yes, your mom still needs to submit the i864 as sponsor, even if she makes $0 income. she will need to add a letter explaining why she doesn't have to file taxes.

for you, it depends if you live with her or not. if you live in a separate address, then you would file another i864 as joint sponsor.

if you do live with her, you would file the i864A as household member.

The petition may be approved, however NVC may put it in storage until it's priority date is met and a visa number can be assigned, until then would not be able to adjust status. What visa class are we talking about? F2A F2B, or is this in the unlimited priority class? How long ago was the I-130 approved?

1) Petitioner always has to provide an I-864 even with no income.

2) Yes you can use an I-864 as a Joint sponsor, OR if you are a member of petitioner's household, you can use the I-864A
