I came into US on J1 in 2004 then i applied for B1 and got approved.I got NOA in mail but then I moved out of my old apartment and i never got the visa. i used some immigration law firm in Atlanta , and i dont remember neither name or adress or even phone #. They requested my original I-94 so I sent it to them. Then I lost passport ssn and ds 2019(No copies left) and US DL, however i got DL reissued. For the last 5 years i was living in the same state, working at the same job and filing tax returns(until i got laid off). Im married to a disabled US citizen for almost 2 years.

My questions are:

Can we file I-130/I-485 package?

Should I file I-102 with the package?

If not what should i do?

Filing the I-102 with the package won't help as the re-issued I-94 comes to you not them... and can take quite a bit of time

If you file the I-130/I-485 without the I-94 then you will be issued a request for it with a very short reply opportunity. If you don't reply withing the stated time frame your I-485 will be rejected and you start all over... best bet is to have the I-94 in your hand before submitting the I-130.I-485.

Even better bet is to remember the law firm and get your stuff back

YMMV
