Timeline

My wife is petitioning to bring her son from the Philippines

her status here is legal resident she has been here for 2.5 years

Her son is 20 now and his birth date is Jan 1 next year to turn 21 cutting it close .

We are going to file a 1-130 he already has his NBI and passport ready and also his birth certificate

anything we should know before we file I have not really done much research but we believe we should be ready to file .

Just noticed that you got marry on August 15, 2008. That means your stepson was 17 years old when you married his mother.

You should be the one to petition for your stepson. This would be an Immediate Relative case; US citizen petitioning for a child under age 21. This would take about 6-12 months. GO FILE FOR YOUR STEPSON NOW WHEN HE IS UNDER AGE 21.

His mother petitioning for him will take years. It could take 3-12 years if everything is done correctly.

In my own opinion based on my experience,,it would be best to file an I-130 petition for ur wife's son NOW before he turns 21.

Also it would be best that you will be the one who will petition her son as u are a citizen and approval is better chance than just an LPR.

I just got my 2 kids here in November of 2010 and my USC hubby was the petitioner and my kids got their 10 yr. green card as they got the IR1 visa. Good luck .

Generally, immigration visas are valid for six months when issued. However, the timeframe may be shorter if the medical will expire earlier.

The important step is that you, the US citizen stepparent, should file for your stepson before his 21st birthday. Under CSPA, his age will automatically locked in and he can not aged out when he turns 21. This will insure that it takes 6-12 months for him to be eligible for an immigration visa.

If you file for him after his 21st birthday, he will have to wait at least six years for an immigration visa.
