Hello! I want to submit the I-131 for Advanced Parole with my application. I looked at other people's posts in this forum and it seems that we need provide some kinda of proof of travel (like reserved tickets).

I am not planning to travel until May or probably even later, so I can't provide any proof of intended travel. Should I still file i-131 now with the i-485 or should I wait until I have more defined plans?

Also, people were talking about a required separate sheet of paper with the explanation of travel plans in addition to i-131 but I can't find this requirement in the instructions. Is it still a must?

Was anyone else in the same situation?

I think you're conflating two issues. For people that need an EXPEDITED AP, some explanation of why the application should be expedited is required. This would include tickets, travel plans, etc. If you're just applying for an AP as part of your AOS package, and don't need it expedited, very little, if any, explanation is required.

My wife just wrote a short note explaining that she would like to visit her 93-year old grandmother for Christmas in Spain, and her AP wa approved without any problem. Of course, it wasn't relevant for us, as her GC was approved shortly after received her AP. :)

Thank you for your response. You know I just realized that I'm more confused about this form than I thought I was. Just to make sure that I'm on the right track: I'm in the US now and I want to travel back home for a month or so in summer if that works out.

I should apply for Advanced Parole not the Re-entry permit, right? And on Part 2 I should check option d. "I'm applying for AP to allow me to return to the US after temporary foreing travel", right? Then I just put the date when I think I might travel and on a separate sheet of paper explain the reason (visit my parents?)?

It would be great if someone could clarify this for me. Thanks!!!

There is actually a requirement in the instructions at part 7. Have another read. But if you read it closely you will see that as you are applying for it with AOS the separate piece of paper is not required. If you send the AP stuff AFTER you've sent the AOS stuff (but before the GC is approved) you will need to include the NOA1 from your AOS application.

You don't need to prove intended travel. If you have plans then you should write the date in, if you don't have plans then just write "unknown" where it asks for date and length of trip. As you have hopes to travel I would write "MAY 2011" in the date section so that if you need to expedite that info is there. It doesn't matter that you don't have anything booked but you do have tentative plans so it's not a lie to write "May". I personally had no plans, I just wanted it for emergencies so mine said "unknown"

Thank you for your advice! I was actually rereading the instructions when I saw again all these warnings in Part 3 for before you file for AP and got confused ;)! I'll follow your advice about the dates. Thanks for your help!

It's not useless if they're out of status, it's useless if they have over 180 days out-of-status because leaving would trigger the 3 year ban.

Anyway - let me ask you this: if somebody had 160-170 days overstay - would you still encourage the person to apply for AP just because overstays are "taken seriously" only and only if they are minimum 180 days long?

Technically they should be fine but I personally wouldn't risk them thinking I arrived earlier or left later than I did. I think (personally) that if it had been 180 days since I arrived (but I applied for AOS before it was 180 days so it's not technically overstay) I still wouldn't use the AP document. Just seems too risky. No-one listens to us though :P

An overstay of 180 days triggers an automatic bar. Yet even with no overstay an CBP officer can refuse you admission to the US. So would I suggest to travel with only 160 to 170 days over overstay?
