Correct the NVC needs to be notified BUT the brother will be left back in Jamaica when your mother leaves. You brother will not benefit from your mother's case. Even if he was 12 and unfortunately there is no lawyer that can help. Your will have to come and inturn petition for him and currently it would take approx. 3 years unless the visa cut-off dates come closer to current which i think it will later in the year.

The plan is to have my mother petition for both my brothers ages 22 and 17, when she becomes a LPR (hopefully by this summer) I asume it is going to take about 5-6 years for the brother who is 22 and about half that time for the 17 year old brother. Besides it will give her enough time to get her own place and my 17 year old brother is in college now.

The plan is to have my mother petition for both my brothers ages 22 and 17, when she becomes a LPR (hopefully by this summer) I asume it is going to take about 5-6 years for the brother who is 22 and about half that time for the 17 year old brother. Besides it will give her enough time to get her own place and my 17 year old brother is in college now.

for the adult brother you're looking at 7 1/2 - 8 years for his processing with the current trends. If the visa category goes back forward then you'll be looking at 5-6 years. If by the time your mom gets gets & the cut off dates are back to normal for the F2A (LPR filing for single child under 21) then the process could be about 1 year.

I mailed the AOS today along with my tax return transcripts. I also mailed my supporting documents of my marriage license and birth certificate as requested my the NVC's website. One of my relatives was going to Jamaica today so I gave him a copy of the DS-230 (with information i filled in). The hope is to have my mother sign it. Then fedex this off tomorrow along with: photocopy of her passport, photos and birth certificate. I will try to have her get the police record sorted out for next week.
