Hello all,

I'm currently waiting for my K1 interview in April. However, I was offered an amazing job I would be crazy to turn down, so I have decided to hold off on emigrating until I've worked the job for a year or two and am in a better place financially (which this job will provide). I know I need to send in some letters, I just want to make sure I know what I'm doing.

I'm going to send a letter to Montreal explaining the situation and ask that my application be withdrawn. I'll include a copy of my NOA2.

Do I need my fiance to send a letter to USCIS withdrawing the petition? Or should we just let it expire on its own?

Thanks in advance.

Your fiance (the beneficiary) does not need to do anything. You (the petitioner) just have to send a letter (snail mail) to the USCIS Service Center where your I-129F was processed (VSC?, CSC?, TSC?) and request that the case be withdrawn. Give a reason and put the Case # and names and dates of birth of both you and your fiance in the letter. Then send an email with the same wording to the Consulate where your fiance was to be interviewed. That's all you need to do. Within 6 to 8 weeks, you will receive a letter from the USCIS informing you that the case has been closed.

Thanks. I'm actually the beneficiary so I'll get my fiance to do that.

Congrats on the job! Not to butt in too much. :innocent: You could always just postpone the interview. Once you're approved you have 6 months to use the visa. It's only 90 days once you cross into the USA. Would hate for you to have to start this process over if you are still wanting to get married.

Thank you.

I've considered that but I want to be in this job longer than a year and I was hired with the expectation of staying awhile. I also don't want to deal with the hassle of having the visa in my passport and going across the border just to visit my fiance all the time. I don't even know if I'd be allowed to, and I don't want to be stuck in Canada for 6 months.

We do still want to get married and think we may go the CR-1 route next time around as it makes more sense for us.
