My Boyfriend Is an American living in the U.S. I Am a canadian living in canada. we have been dating online for about a year now and we would like to get married and go with the k1 visa so i can go to the states, get married to him and eventually get my green card down there. he already has a steady job to support me and a place to live already. Yes we have met in person, we talk constantly, and everything else. Basically though, i was on my way to the US for the first time 2 weeks ago to go up to the US to go visit him because he always comes down to come visit me and we thought i could go down for once. It was my first time on a plane and across the border. I ended up getting "flagged" because i didnt end up having the right proof to show i was coming back home to canada after my visit there and i had to much luggage apparently so i looked suspicious. so i was flagged for looking like an illegal immigrant when i wasnt trying to be. We would like to file for the K1 visa in a few weeks here but i have some questions: would it look suspicious and make them say no to the visa or going because we are filing for it so soon after me being flagged? is the visa difficult to get? is the visa harder to get if i was flagged? can someone please give me any advice at all, long or short and personal experiences of a canadian going on a k1 visa to the states to get married and if its a very hard process or not? any info would be greatly appreciated!!!!

Having a flag, or even a denied entry to the USA will not affect processing, or approval of a visa. What would cause issues would be accumulated overstays exceeding 180 days.

You should have no problems with this.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

At the interview you will be asked if you were ever turned away at the border. You will HAVE to tell them yes and why. Just explain you were going to visit him and they felt you had too much luggage and not enough ties as you told us here. Trust me it is not a big deal.

Most people file for K-1 after being denied entry anyways lol

Youshould be fine as long as you are honest when filling out the K1 application and at the interview. As long as you are honest and you have NOT overstayed at anytime, I think you would be fine. Good luck on your journey to our country.

Ulorinvex, the same thing happened to me. I went to visit my fiancé for 3 months (maximum allowed time) and I was almost sent back because they suspected I would never return to my home country. I had too much luggage too. I was let through eventually (after some harassing like giving out my e-mail password...) but the officer said I was flagged and he would watch whether I would be on my return flight 3 months later. I was of course. As long as you don't overstay, it won't matter. We filed the papers during my stay and I got my NOA2 recently without any problems. It's not a hard process, you just need a lot of patince. Good luck!
