Hello. I'm new in this site. My husband went to a tax accountant last year to prepare our tax income. When I was checking my list of evidence that I need to submit I notice that our income tax are SINGLE not MARRIED.I'm filing my ROC this week. What do I need to do? Can this effect my ROC? I hope somebody could help me. Thank you.

I'm kind of amazed the accountant let you guys file separately as you (in most situations, yours could be different of course) usually get more tax benefits by filing joint. Either way, you guys probably still both filed taxes, all you need to do is to send BOTH your returns so they can see by the address you live together :)

It won't affect your ROC I don't think but I'm pretty sure it's illegal to file single when you're in fact married.

If I were you I would speak with the accountant about amending the returns. Not only will you probably end up with a bigger return but it's the legal way. Even if you wanted to file separate it would be "married filing separately" and together is "married filing joint". I would do that before filing ROC. If you're deadline is close i'd file with what you have but still speak to the accountant so you have the amended return for the ROC interview.

Yes, that is a big friggin' deal, as that's one of the main things the Immigration Officer is really looking at ROC.

You need to have this corrected ASAP via an amended tax return, and once processed get tax transcripts for 2008 and 2009 directly from USCIS.

oh my.. I didn't even read it like that.. you guys are right, in that case it will make a difference indeed for them.. sending in both returns wouldn't be good either then because it would still say single :S
