Confusion on path. Please help!

Hello All...

I have joined VJ just recently and up until today my husband and I have felt pretty certain about what path we were going to take as far as immigration. Now, after countless hours of preparation we are both burning out. The more we read, the more confused we get. If someone would be so kind as to read my many questions and possibly give me a hand I would really appreciate it! :)

The story:

My husband is American. I am Canadian. We have been married for a little over 7 month (together for a year and a half). We have a daughter (granted US citizenship). I must be able to travel back to Canada freely once in the US (I know some visas do not allow travel when Change of Status is being processed)

Given the situation, here a few questions...

Originally we were looking at the K3 visa but then we found about how the i130 followed by the i129 can be used to bypassed the k3 visa step.

Question 1: Is this the same thing as the ir1/cr1?

Question 2: Is this the right route for us (in our situation)? Is this the appropriate process to have me immigrate to the US in a timely fashion while enabling travel to Canada once I arrive to visit my other family (daughters)?

Is the K3 visa the appropriate method OR do we want to do the i130 followed by i129? Which is faster and/or appropriate for our situation?

IR/CR-1 are just about the same except IR-1 applicants will receive a 10 year green card and the CR1 spouses will get a 2 year CR-conditional residence - green card upon entering the USA because the marriage with the US Citizen is less then 2 years. You will be required to file for Removal of Conditions 3 months prior the 2 year anniversary.

The K3 is now dead. You would follow the CR-1 route. Once you have the visa you enter the US and if you need to, you can go right back to Canada. You would have a I-551 stamp (greencard stamp) put in your passport and some time after you arrive in the US you will receive your GC and SSN in the mail.

As stated above, if you've been married more than 2 years at the time of entry you will receive a 10 year greencard. The CR-1 process will take roughly a year so you will make it close to the 24 months marriage required to get the 10 year greencard.

Sometimes you enter and they accidentally send the wrong card so if you DO enter the US after you've been married two years make sure to point that out to the person processing you at POE (point of entry).

Summing up what has already been said, the K-3 is dead. You'll follow the path for a Cr-1 visa

FYI, you'll interview in Montreal so add any travel costs you might be adding up. It is the only consulate in Canada that does immigrant visas.

Also, there are only 4 doctors in Canada that will do your immigrant medial - Toronto, Vancouver and 2 in Montreal

Thanks guys, we sent the package today! Montreal? That really sucks... :|

Thats one heck of a trek for me (I'm closest to the Vancouver one)

I know, MANY spouses have tried to get their petition sent to Vancouver from Montreal but it just doesn't work. The only consulate that deals with spousal visas is Montreal

Maybe we will just make a trip out of it? :) I have never wanted to see Montreal but maybe I can pretend it is the most desired locale! Time to start saving! Thank you for letting me know about that. How long does that usually take to come up (getting the appointment?) Do they set the date or can we?

After you have completed all administrative processing with the USCIS and NVC you'll have to wait for NVC to assign you an interview. Assuming all goes smoothly with your petition, it can take anywhere from a year or more. You are fortunate though because apparently the backup at MTL is being cleared away pretty fast, and they have been assigning interviews at a faster pace. So its very possible to complete this process in one year.

10/10/09: Married in Hamilton, Ontario :)

04/01/2010 : I-130 Sent

04/16/10 : NOA1 Issued (Hard Copy)

09/02/2010: File Touched Fingers Crossed

09/24/2010: NOA2 Approval!!!
