NOA and applying for residency deadline.

Hi guys im from the philippines. please help. I need an advice. I came here for fiance visa. I'm getting married next week. But my visa will expire on feb11, 2011. Do we really have to apply for Permanent residency before my visa expires? now we are rushing to finish th papers before its too late. thnx.

and one thing, what is NOA?

Sorry to say but your VISA expired the day you used it to enter the USA.

Your talking about your I-94 that expires.

You should get it done as soon as possible but it doesn't have to be done before the I-94 expires. Tho the longer you wait the longer you cannot work and cannot travel out of the USA.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hi. Thanks for the reply. Yes im talking to my I-94 which expires on feb11.

So you mean it's ok to file an application of adjustment of status even after feb11?

I'm just afraid to deport after my 90 days of staying here.

if you marry before 90 days you won't be deported,the notice of auction noa1 is a receipt letter, that they received your petition,the notice of auction 2 noa2,means your file was approved,do file your aos asop,

A..Right away, or at least right after your honeymoon. You should make every effort to get the Adjustment application filed within 90 days of the fiance(e) entering the United States, which is when the K-1 status expires, as indicated on the I-94.

Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many newsgroup couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, newsgroup experience has shown this is not a major issue with local USCIS (INS) offices.
