filling out cards for e.i., first time

Hey Everyone-

I P.O.E.D, Dec., 2, 2010...on a k1 visa, I opened my claim for e.i., before leaving - I9 just had a friend bring in a copy of my r.o.e. as it wasn't ready when i was leaving; smooth so far!..We are residing in Maine, but went to Michigan to get married - where Ken's daighters live...), Dec 18th! yeah finally...Dec 21; Ken got very sick and was taken to e/room and eneded up at Pittsburgh University Medical Centre (montefiore) for 6 days...at any time...i am just getting back to Maine and have a card for 1 week and a card for 2 weeks...so I filled them out and the question where it states "were you ready and willing...." i put yes b/c apparently on a I94 we are K1 visa holders are eleigible to work until the I94 expires...wow ...ok...so I am dropping them in the post on Tuesday, as holiday here on Monday. I have enclosed a copy of our marriage certificate as well as a copy of my passport and the I94....Is this right so far>>??? We havent started the a.o.s. so far.

and yes i added Canada under belleville on, on the envelope!....LMAO

Any and all help from fellow vj'ers has gotten me this far! Thanks in advance...sincerely.

Always a lot of confusion of a k1 can work or not work!! I came on a cr-1 so do not keep up with the k1, but I thought one also required the EAD stamp at POE which 99.999% of the time they no longer hand out. To add more confusion to the situation the CDN EI people said no to the k1'ers without the EAD, but some wihtout the EAD did get EI--all depended who handled ur case.

As well--if one is on holidays or not actively looking for work, one is suppose to be honest and thus not collect for that time period--just saying. Ensure you keep a record of the places you have applied to--they can contact you and ask for that information. Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Actually, you need your EAD before you can start collecing employment insurance from Canada. I applied before leaving Canada in July 2010. They would not start paying me until I got my EAD or permanent green card. I was penalized 5 months while waiting for my EAD, because I was not eligable to work in the U.S.

Even if one does not have the EAD--one still has to file right away! Maybe you will get lucky and get EI anyways! Just hope you don't have to pay it back!! Just because one gets the EI cards does NOT mean ur were approved or going to get $$$.

my friend on K-1 had to wait for her EAD to file.

K-1 are not authorized to work untill they have an EAD - there are NO authorization stamps for k-1 visa holders. If your passport is stamped you are NOT authorized to work with that stamp.

You must have ead or green card.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

This is a common misconception you used to be able to get a stamp in your passport, and EI would accept that as proof of being able to legally work....even though technically you were not. EI now knows that you require an EAD or GC in order to work, so you will have to wait for those. You will need to change your answer on you card.

I just think it's so unfair we cannot file out the cards online. The mail takes forever, or I should say Canada Post takes forever.

Once I had my EAD and things got started, I seldom filled out cards (if at all if I remember correctly) - the cards always arrived late anyway - EI would update my details when I called , not sure if they still accept people calling.
