TAX HELP, 1040 AND W2

Timeline

Just a quick one, i have been sent the i 134 form and fiancee earned 11768 but on her 1040 it says 11707 but on w2 it says 11768 she put 11768 on i 134, the 60 dolla diff is for her 401k, will this be a problem

As she files electronically print outs are ok|

The consulate usually considers the amount listed on the 1040, and this is the good example of why they do that. Money which is contributed to a 401K plan is not money which is available to support the intending immigrant. That money could not be made available to support the intending immigrant without financial harm to the sponsor (a 10% early withdrawal penalty plus taxes).

Anyway, she doesn't qualify to be a sole sponsor at that income level. The extra $60 wouldn't be enough to change that, so it's really irrelevant. She's going to need a joint sponsor.

Print outs from tax prep software are ok, provided they include every form and schedule that would have been included if she'd filed a paper return rather than filing electronically. She should also sign the 1040. It's usually better to use transcripts from the IRS because they prove the sponsor actually FILED the return, and they show the numbers accepted by the IRS. She can get transcripts at no cost by calling the IRS.

She needs to make $18,212 for a 2 person house hold to meet the requirements. She will need to find someone to joint sponsor like JimVaPhuong said because right now she does not qualify.

It would probably be sufficient if she just signed it, scanned it, and sent it to you so you could print it yourself. You don't have to submit original tax documents. If she'd actually filed a paper return then it's presumed that the original would have been sent to the IRS, and she'd only have a photocopy anyway. The signature is necessary because the 1040 form contains a declaration by the taxpayer that the information is correct.

Because people have had them rejected for not signing. It's an easy thing to do.

I'm concerned about you saying she "printed off the W2". That's something you photocopy from the W2 mailed by the employer, not print off TurboTax. Just wanted to make sure that's what you're getting. What you provide for immigration has nothing to do with e-filing. It must be a paper return that would be exactly like one mailed in to the IRS which is signed on page 2. That would include Form 1040, and any schedules like Schedule A, B, C, D...anything called FORM XXX or SCHEDULE X, but nothing called "worksheet". Those are extra TurboTax generated pages. AND of course a photocopy of the W2 as it came from the employer...that is often the size of 1/4 of a normal piece of computer paper.

Taxes filed electronically are also signed electronically. The IRS uses personally identifiable information (a PIN number or information from the previous year's tax return) to identify the person submitting the return and providing the electronic "signature". The same declaration applies when signing a return electronically.

When you print the tax forms you don't have the ability to sign the printed document electronically. You have to pick up a pen and do it the old fashioned way. IRS transcripts are simpler - no forms, no signatures, and no supporting documents like W2's. The consulate will also trust an IRS transcript more than printed copies of tax return forms because they prove a return was actually filed, and provide the data the IRS recorded from that return.

She gets it from her employer electronically, so she has printed from her employer homepage, she does not receve a phyisical copy anymore.
