K1-How long can you wait to submit a packet 3?

*Sighs* Let me start this discussion, not one that I wanted to happen but became reality. My K1 case was sent to Guang Zhou consulate in late November and the packet 3 was sent to my fiancee in early/mid December. She has dragged her feet the whole time, last week I asked her how the paper work was going and she informed me that she has not started on anything and would after the New Year celebration. Yesterday we talked and she told me to stop the process, she did not want to leave her family. My heart dropped out of my chest. I talked to her and wanted to know her reasons, she was concerned about not finding a job here, leaving her family, and depending on me. I tried to comfort her about the job and family part but she insisted that I cancel the process.

I have a couple of questions, if I decide not to cancel the petition how long can we wait to turn in the packet 3? Also if she does really want to cancel the petition what happens in the future? Could I at another time apply for a new petition for her? If not what are my chances to get another petition approved if I were to find someone else in the future?

I am so upset over the change of events, I just don't know what to do but to ask everyone here for advice. Thank you for your help and best of wishes to everyone else in their petitions and love life.

I don't know how long you can wait but yes you can submit another I-129F later on down the road for her OR for someone else.

If she has changed her mind then my advice is to let it go. She does not want to leave her family I understand that as Chinese people are very close like that. You need to decide to cancel it after many long discussions with her. If you cancel it you would have to start all over again and you would get a new packet 3 and so on. Yes you will be able to apply again if you meet someone new or a new one for her if your relationship continues. Good luck and I can imagine you are heartbroken as well as out of pocket. Take care .

usually, have 1 year from GUZ IV 'Casefile opened' to 'packet 3 returned to IV Unit'.

Usually.

But must have an email conversation with GUZ IV unit, or after 4 months of 'casefile opened' time tick, they might close the casefile.

Have you explained to her contact with her family will be easy, texts, emails, phone calls, QQ web camming? The next petition I guarantee will take much longer. You will be on alert for fraud after your first petition. They will make you wait just for the sake of waiting. If you and her decide for her not to come it's best to hire a lawyer to cancel your petition with out prejudice, I found out the hard way. I am not clear as how to cancel it and close the case. It's not good for you though. UGH Good luck I hope you 2 can work it out.

I'm sad to hear this, but as a Chinese woman I understand her concern. Had she ever spend some time in the US? If not, try to get her stay with you as a real couple in the US might be helpful. Give no pressure, just ask to give you both a chance trying some real quality time as a couple living in the US, she might realize USA is just the other side of the earth, it's not that far away, people are little strange but most of them are nice. Also, you could try to make a deal that few years later, we will move to China together, so it is only few years for her. Hope that helps. Good luck to you both.
