I got my green card through employment many years back. However, due to family issues i moved back to my home country and never return to reside in USA. I relinquished my green card last year. The good news is my wife and kids are US citizen and they have been living with me outside of US all these years. Now that the kids are grown up, we want to move back to US so that the kids can study and the whole family can settle down in US.

I am asking my wife to sponser me and get the IR1 visa for me. I have few questions and hope this forum can have with the answers.

1. Does relinquishing a PR status going to have negative effect on my new IR1 application? Any conern that i should be worry about?

2. Is there a rule that says how many time one can apply IR1 visa or held a PR status?

3. Is there a time lapse between relinquishing a PR and reapplying a IR1 status again? I just relinquished my PR last year in March so i have concern if i apply IR1 again in less than a year in between.

4. Will there be some trouble during the interview due to my past PR status?

Snoopyee,

You should check with your consulate you may be able to do a Direct Consular Filing... This is much faster than applying for an IR-1/CR-1 Visa. As you don't have your country listed there is no way of advising you further on that.

Typically it takes 3 months for your paperwork to be completed. Check the guides for further info.

You should check with your consulate you may be able to do a Direct Consular Filing... This is much faster than applying for an IR-1/CR-1 Visa. As you don't have your country listed there is no way of advising you further on that.

Hi Mrs. Jones.

Thanks for the fast response. I am currently reside in Singapore and plan to do a direct filing with the US Embassy here.

I am just having some concern that I have relinquished my green card in the past and whether there will be any concern in applying a new IR-1 visa now through my wife US citizenship status.

There shouldn't be any issues, as you did the right and legal thing by handing back your greencard. They may ask why, less than a year after relinquishing it, you want to immigrate again, but other than a couple of extra questions at the interview, you should have no trouble.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
