My now-wife, entered the US 2 months ago on a K-1 Visa.. We were maried.. She has her daughter back in her home country and would like to return to spend a few weeks with her daughter.. Her daughter will be comming to the US this year, but in the mean time, I would like to give her some time back home with her child..

We are completing our forms for the AOS and was wondering about the use of Advance Parole for my wife to travel home to see her daughter..

What are the requirements in which AP can be used or are there stipulations regarding traveling once the AP is received?

AP is routinely approved as a part of the I-485 package. You can just put "unknown" in the trip field. It takes 2 -3 months to get approved, and then she can travel. My husband used it and I was scared - all sorts of people getting me paranoid that it was iffy... it was totally fine. I wouldn't use it to stay out months and months, but I don't think there is any sort of limit on it. Hope that helped.

It can be used for any reason. The only stipulation is that having an approved AP document is not a guarantee that she'll be readmitted to the US. That's still up to CBP. However, as long as nothing has changed since her entry with the K1 that would make her inadmissible (conviction of a crime, overstay of more than 180 days, AOS denied while she was gone, etc.) then she shouldn't have any problems returning.

If you happen to get scheduled for an AOS interview you must make sure she comes back before the interview. Missing the interview would automatically mean the AOS is denied.

Regarding the Interview, what kind of notice is typical? How long before your interview are you notified (more or less)?

I seem to recall we got the appointment letters three or four weeks before the interview.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
