Hi, I am jut starting the process. My husband and I married in November here in the USA. He is currently back in OZ to tie up work contracts and find renters for his home etc..

I was wondering how difficult/easy anything it is to go ahead and fill out the forms... can someone explain the "filing dates" I'm starting to read about? I want to send the I-130 right away but do I need to wait to send that along with the permanent residency/change of status applications?

I just need a very dumbed down explanation on the process and how to get started? Im sorry, Im sure this has been asked A MILLION times before, but Im looking for the easiest explanation with step by step processes.

And the worst question a newbie can ask: how long will this take? He and I have no kids, no previous marriages, no criminal backgrounds and pretty good careers... is there any way we could be lucky and get his visa to come here fast?

THANK YOU SO MUCH for any feedback!

Michelle

filing dates..? perhaps you're referring to the priority date? if yes, that is the date the application/case was accepted by uscis that's important to keep in mind more so for the family pref. category. You wanted to know how long it will take. Are you a us citzen or permanent resident (green card holder)..?

1st marriage, no kids, good careers plays no part in how quick he will be processed. the clean background help but a small part it just prevents any delays nothing more.

you can read up on the step by step instructions at the link below.

You won't need a change of status application, as you are petitioning for a visa via the I-130; this will allow your husband to apply for a visa, which, once he enters the USA, will get him a greencard. The guides mentioned in the other post are excellent.

The whole process, with no problems along the way, should take 7-10 months.
