I-130 and I-129F

Hi every one I’m new to this form.

I just was wondering if any one might know what the time frame might be know that my husband’s applications (I-130 received 8/14/10) and (I-129F received 8/24/10). I check on the INC web sit and they were both approved on 1/13/11 and it said I would receive a letter telling me what to do next. I called and they wouldn’t give me any information but to wait for the letter.

Could anyone give me an Idea how much longer it might take for me to bring my husband from the Dominican Republic. Some tell me it will be fast since I’m American. Is that true? I’m getting tired of flying every month….

The K-1 forum is about filing an I-129F for a fiancee visa. Moving this thread to the CR-1 forum.

Since they were BOTH approved, you WILL be doing CR-1 spouse visa, NVC WILL close the I-129F and proceed with the I-130 for CR-1 or IR-1 if married more than 2 years, this WILL save you time and $$$ because no adjustment of status is involved later.

2-3 months at NVC, and another month or so at the consulate.

Prepare I-864 for NVC, and your spouse will be sending DS-3032 to NVC so that you can act as his agent for dealing with NVC.

How will the Department of State process my K-3 visa petition?

Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:

  • The nonimmigrant K visa will be administratively closed.
  • The application process explained below will not be applicable and cannot be used.
  • The NVC will contact the petitioner and you with instructions for processing your IR-1 (or CR-1) immigrant visa. For more information on the immigrant visa process review the Immigrant Visa for a Spouse webpage.

If the NVC does not receive your I-130 petition and I-129F at the same time, the NVC will process your I-129F petition. Then NVC will send the petition to the embassy or consulate in the country where the marriage took place. If your marriage took place in the U.S., the NVC will send the petition to the embassy or consulate that issues visas in your country of nationality.

Over the past year or so USCIS has been tying the two petitions together and approving them at the same time, and sending both to NVC at the same time.

The above statement by DOS makes sense, the whole reason the "Life-ACT" K-3 was developed was for the Spouse of US citizen to be able to enter the USA and WAIT for I-130 approval, at the time K-3 was developed the I-130 was taking a VERY long time to process through USCIS to approval, and the I-129F for non-immigrant fiance visa was fairly quick, so it was setup so that a spouse waiting for approval of their visa petition can be treated like a fiancee and come to the USA in about the same time as a fiancee.

I guess all the extra fees paid to USCIS has actually resulted in some improvement in service, the I-130 no longer is taking years to approve so the K-3 is starting to become a thing of the past.

Question? As I'm going to DR next week Can I take the form DS-3032 and have my husband sign it and send it myself when I submit our paper work????

Read the EZGuideSpouse for more details. Also, fill out the DS-230 before you go and have him sign part one. You should probably have him sign multiple copies of everything. And of course plan to get and bring back his birth certificate (inextensa, legalized), marriage certificate (inextensa, legalized), police certificate, and divorce documentation (if applicable). Oh, and a photocopy of the bio page of his passport and 2 passport-sized photos of him (plus some extras). Then you should be all set for NVC!

I've been trying to get a better idea of how long it takes NVC to schedule interviews for the DR (after they review your AOS and IV packets and complete your case). It seems like some people get an interview date in 3 weeks, some get one in 3 months! Cross your fingers that things are speeding up, not slowing down!
