Hi guys! My husband and I want to remove conditions on his greencard, but we have been out of the US a lot in this past year and in his country. We have been in Jamaica last year from about May 15th to October 9th, and then again from December 8th to now. We are supposed to file in March (three months before expiration). Is this going to give us any problems?

Thanks!

Removal of conditions is about showing you are in a bonafide marital relationship living together and requires evidence of living together, I-751 does not ask about time out of country.

Later if an when applying for citizenship, you would document trips abroad.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

Also, as an addition to YuAndDan's reply, please keep in mind that you should be at least 185 days (6 months) per year inside the US or they could actually say that you're not residing inside the US and, with that, they could actually revoke your GC, deny access into the US even when you have a GC, or deny citizenship for the same reason. Also, while normally you're able to get citizenship so many years after entering the US and having a GC and such, travelling that much might also makes the waiting time for you to actually be eligible for citizenship longer. And, besides all this, it might also makes filing taxes (and several other things) a lot more difficult as you would be considered a nonresident at that time.

I see you guys are very close to those 6 months per year, please be smart enough not to go over it because it can actually cause a lot of trouble. If you really want to travel this much out of the country, it would be best to wait until you have citizenship.

I doubt they will make any trouble if you have proof that the intention is to keep residing in the US (think about keeping your house, job and such).. it gets a real problem if you stay out of the US for over a year without re-entry permit (but ok, even then with the right amount of proof and such).
