My AP got approved on 1/13/2011. If I don't get it in mail untill 1/20/2011, can I leave USA without it, and hubby Fedex it to me when it comes in the mail?

What if the AP papers got lost in the mail when he tried to mail them to you? you would be in big trouble! I would not leave without it.

CPB made sure I knew when I called and asked about AP and I-94s NOT to have my husband leave without the physical paper copy in hand. You will get the physical copy within 6 business days of approval, so I would guess this Thursday.

thursday is soon enough, I guess...thats when I was supossed to fly back home for a visit. The good thing is I have a late flight (9pm), but I still hope I get it by tuesday or so...

As long as the AP documents were approved before you left, that should be fine.

As others have noted, it's a risky move, that has serious consequences should something go wrong, and should therefore not be done except in an serious emergency, but yes, if your AP documents were approved before you left, they will work to get you back into the US as long as you have them in your hand when you go to reenter the US.

If anything, anything at all, prevents you from having them in your hand at the PoE, you will have a VERY stressful (and most likely very expensive) next several months trying to arrange for either humanitarian parole or (far more likely) a spousal visa with which to reenter the US.

I would not personally be comfortable with that level of risk, nor, I think, would most of the people here, but that's a choice you have to make for yourself.

I decided to wait for the papers so I can take them with me. One thing that concerns me is, USCIS hasnt updated my AP status at all, I was notifified about approval by congressman ONLY.
