2010 Tax Return - Dual Status with foreign income

Ah no you are right, it excluded 22,052.

Since I'm juste a little over than that, we're getting a huge refund.

I can't believe it yet.

Now I am confused about the State Taxes.

It seems to not be included in the basic TurboTax...?

Do you guys file at the same time?

Have you included your income yet? In TurboTax it is under less common income. Some people jump into the 2555 and exclude before they put in the foreign income and get all excited over the refund showing until they enter all of their income. Just checking...

Can't help you with that one. Texas has never had a state income tax so I'm clueless how that works.

Yes yes we have included all our incomes!

Well I did the step by step, so all of our incomes are listed but most of my incomes get deducted then.

My husband paid his withheld taxes as single so we do get a refund on the taxes he paid and also the 800$ credit.

Huge was maybe a little exagerated. ^^

According to TurboTax we do get a refund of 1600$.

It's huge considering the fact I thought we would have to owe.

One last thing, it seems everybody uses TurboTax and efile?

Therefore there is no statement that says that we choose to be considered as resident for the whole year...

Does this statement really matters....? Would it be better to file on the paper and add the statement.

So basically everybody uses this:

Physical Presence Test

To meet this test, you must be a U.S. citizen or resident alien who is physically present in a foreign country, or countries, for at least 330 full days during any period of 12 months in a row. A full day means the 24-hour period that starts at midnight.

To figure 330 full days, add all separate periods you were present in a foreign country during the 12-month period shown on line 16. The 330 full days can be interrupted by periods when you are traveling over international waters or are otherwise not in a foreign country. See Pub. 54 for more information and examples.

Note. A nonresident alien who, with a U.S. citizen or U.S. resident alien spouse, chooses to be taxed as a resident of the United States can qualify under this test if the time requirements are met. See Pub. 54 for details on how to make this choice

Congratulations on the refund. People don't believe it when we say file jointly even if you claim your worldwide income. It just seems like you're going to get screwed on taxes. But you don't. I guess it takes working through it to see it. If husband filed married filing separately, the refund wouldn't be so nice.
