How long can I stay out of the country in which we are applying through DCF? We are having our first child together but I have to return to the United States without my husband (because he doesn't have a visa). The country we were living in is too unstable to have the baby. I am wondering how long I can stay outside of that country without losing residency. I will become a citizen of that country in Feb, through marriage, if that means anything. And we have lived there since 2009. However, it is now time to leave that country and move to the US. While I am here I will look for a job and place to live. Any suggestions?

Once your DCF is accepted you are actually expected to return to the US to prepare to live there and be able to support your spouse. The key is being a resident at the time the DCF is accepted.

The problem is I had to leave the country before I could initially file the I-130. I wish I had before I left but I am already in the United States and the Embassy is in the middle of closing because of the political situation. I am 6 months pregnant and if I return I will not be able to return back to the US. This really sucks. I am due in April so I am hoping to return after the baby is born and file. However, my question is how long do I have to live out of the Ivory Coast before I lose residency. In the mean time I am looking for a job here and an apartment. Our first choice would be to file DCF.

Could I use this as "actions towards domicile in the US/intent to reestablish domicile"

Hello!

My Green Card for the Ivory Coast ends July 27, 2011. I am guessing that I wouldn't loose my residency in the Ivory Coast then. I mean I will only be living outside of the Ivory Coast for 4-5 months and I would return before my residency card expires. And for a very good reason. I am just wondering if it is possible before we start going down this path. Otherwise we will have to go with plan B.
