FILING i-130 FOR BOTH PARENTS

Hello,

I will be filing N-400 in July and would like to bring my parents here next year.

My problem is that Mom Dad have lived together for over 40 years and have never been married.

His name is not on my Birth Certificate. (wasn't a necessity 40 yeary ago)

Should i go ahead and put his name on the Birth Certificate now? (It's a process that takes a little time in Jamaica)

Should Mom and Dad get married before i start to file their I-130?

What can i use to prove that we have live in the same home and that my Mom and Dad still live together?

04/23/07: petition sent to TSC

05/01/07: petition received at CSC

05/01/07: NOA1 Date.....no hard copy

08/06/07: Fiance called USCIS for info aboout NOA1 hard copy

08/07/07: Touch

08/08/07: Touch

08/09/07: Touch

08/10/07: Touch

08/11/07: NOA1 hard copy

08/21/07: Touch due to phone call was told that our case has been assigned

08/27/07: Touch

08/28/07: APPROVED!!!!!!!!!!!!!!!!!!!!! ( Received e-mail that our case has been approved on the 27th)

09/18/07: Petition left CSC

09/24/07: NVC received Petition

09/26/07: Petition left NVC

10/02/07: Kingston Embassy received Petition

10/04/07: sent off DS-230 part 1 (sent via courier service)

10/09/07: Packet 3 received

10/09/07: Drop off DS-230 part 1 (in person)

12/03/07: Medical

12/18/07: INTERVIEW DATE!!!!!!!!!!

01/04/08: VISA IN HAND!!!!!!!!

01/11/08: Arrived in the USA

03/23/08: WEDDING DATE

09/19/08: AOS approved

09/25/08: GC in hand

yes you should do it now if you want the application to be accepted by USCIS

Should Mom and Dad get married before i start to file their I-130?

your mom/ dad not being married have no effect on the case. They can get married if they want to but not for immigration

What can i use to prove that we have live in the same home and that my Mom and Dad still live together?

you dont need to do this when they are your biological parents

Your response is greatly appreciated

What can i use to prove that we have live in the same home and that my Mom and Dad still live together?

i forgot to add some more info. to the above question.

you can use info like school / church / medical / census records. Photos will be a good alternate proof of the parent-child relationship. Also you can submit affidavits - sworn written statements proving the parental relationship.

keep in mind that USCIS OR THE US CONSULATE will require a blood test if his name is not on your birth certificate or added later. More likely it will be requested at the us consulate level. In most instances illegitimate children can gain/request immigration benefits almost as easily as those born in wedlock so your dad will be ok. your mom will get processed/completed before him. i'll say expect your dad to be in the U.S. early 2012 due to the DNA rest.

you're welcome . HOpe some others can shed some light but they are often so quiet on here "on this side" sometimes i just SMH.. they're comming though I know Sus and trelawny who have busy lives and they always come to the rescue.
