Hello everyone!

I'm filling immigration forms for my wife. She came to US by visa J-1 and overstayed. Now she is married on me US Citizen. She came to US in Jul 2008 her visa expired on Aug 2008, She worked for her job offer only for two weeks. On Aug 2008 she also tried to apply for visa B-2 visitor and got reply from USCIS : WE are not opening removal process right now, but you have to live country "US" with in 30 days but if you want you will be subject to removal proceedings.

My questions:

Form I-485

Part 3 Processing information continue

QUESTION 8:

Have you ever been deported from the US or removed from US at government expense, excluded with in past year, or are you now in exclusion, deportetion, removal, or rescission proceedings?

What should I answer Yes or NO?

QUESTION 11:

Have you ever been a G exchange visitor who was subject to the two year foreign residence requirement and have not yet complied with thet requirement or obtained a waiver?

What shuld I answer Yes or NO?

Block A:

Have you ever applied for Permanent resident status in the US?

What I have to answer here If she applied for DvLOTTERY GREAN CARD on OCT 2008 and didn't win

Part 2 Application type:

What box should I check for her A or B?

Form I-G325A

We filling two forms of G325A for each of as, What should I answer for "This form is submited in connection with an application for?" For me and for Her. For her how I understood I need to check box "Status as Permanent Resident" is it right? But what I should check for me?

Form I-864

Part 1 Basis for filling affidavit of support:

What box should I check if sponsor is my father but I'm filling for the immigration of m relative-wife?

this is posted in the wrong section for 1. its not a family based visa that is being adjusted from. No your not filing a 751 your way ahead of yourself you don't even have a status to remove conditions from.

this is posted in the wrong section for 1. its not a family based visa that is being adjusted from. No your not filing a 751 your way ahead of yourself you don't even have a status to remove conditions from.

Check the J-1 visa and find out if she is subject to the 2 years home residency requirement/pararaph 212(e). It might be written in her passport under her visa. Block A:

Have you ever applied for Permanent resident status in the US?

Not sure, as I don't have the form in my hands, but I guess your father is a co-sponsor in this process. You as a USC are still the main petitioner. I'm sure other VJ users who have been in the same situation would give you a better advice.
