Apparently I didn't use the correct I-129f form? I used one dated 05/23/06, when it should have been 07/30/07. Darn! :bonk:

"The application/petition was filed on an outdated version of this form. Please resubmit your application/petition on the current version of this form with the appropriate fees to the USCIS address listed on the bottom on this notice."

They stamped my check, in the area of "Pay to the Order of," with their U.S. Department of Homeland Security stamp. Should I use that one still, or just write a new check?

All of the forms & supporting evidence that I provided, has been scanned, on the right side of the documents. Can I still use these documents? Obviously I'll provide a new I-129f form, with the latest, correct one.

Also, I realized just after sending it, before getting this notice, that I should have put her SSN on her G-325A. When I resubmit, is it ok if any of the info has been modified or added to, in order to provide a more accurate petition? I'll have her do a complete different G-325A obviously, but will have her include her SSN this time.

I assume you're the petitioner and your fiancée is the beneficiary, so on her G-325A you do not provide a social security number as the G-325A explicitly asks for the U.S. social security number and I assume your fiancée doesn't have one..? You don't supply the social security number that she has in her country, only the U.S. one, if any, as the form states. If she doesn't, put "None".

I am the petitioner, she is the beneficiary, she has a SSN, she did a 1-year work visa, J-1, in US, & was given a SSN & card, which is present on her W-2 form that I submitted as evidence.

Before submitting, I didn't realize her SSN was her's for life. After submitting, but before the rejection notice, I realized I should have had her put her SSN on her G-325a & me put it on the I-129f.

So my question was is it ok, when I resubmit, to "resubmit" "fresh" documents.

Yeah when you send back you can edit some things as they did not process it or enter it being the wrong form.

Just fill in new 129f form and add all the documents you had before along with new G-325 . If she has a SSN then yes I would put it and don't forget yours on the 129f

I wasn't planning on doing a new G-325a; though I did a new I-129f, as it's the document that was the older, incorrect form.

Should I? Or, why do you advise also doing a new G-325a? Because of the SSN? After researching these forums, my logical conclusion was white-out.

Also, what about the dates, differing now, from the I-129f, & the Letter of Intent, etc.? Meaning, now that I've done redone the I-129f, I've dated it Jan. 15, 2011. Whereas my Letter of Intent is dated Dec. 30, 2010. Will this be an issue?

As for the check, I've decided to just trash it, & send a whole different one. Just to be sure.

If I were you, I'd simply fix what they asked me to fix. No need to redo your whole petition simply because of one outdated form.

Yep, my thoughts exactly.

I'm fixing the lack of her SSN, & re-doing a I-129f form, latest version. Writing a new check. That's it.

I got an I-797 today submitted an outdated form. I thought I was so careful in checking everything, guess I was not. :( The form is exactly the same except that the expiration date is different. There is a letter attached to it that you have to send back saying "The will flag your application to receive special attention when it is re-processed" will this expedite the process or make it take longer. And can I send it express again so that it will be there the next day?

08/09/2008 - Met on Yahoo through a mutual friend

03/01/2010 - 1st visit (fiance came to US)

05/11/2010 - 2nd visit (fiance came to US, spent his birthday with me)

10/01/2010 - 3rd visit (fiance came to US)

02/11/2011 - 4th visit (fiance came to US, proposed to me on Valentine's day)

04/06/2011 - I-129F Sent

04/14/2011 - packet rejected and sent back -expired I-129 form

04/15/2011 - I-129F Sent out again with correct form

04/20/2011 - NOA1 (hardcopy recieved)

06/21/2011 - 5th visit (fiance came to US)

07/11/2011 - NOA2 (YAY !!!)

08/05/2011 - NVC Case #

08/16/2011 - Medical

11/04/2011 - Interview - Approved 221g (ACPO Police Certs needed)
