I am trying to find out what information I will need to bring my future finacee's children to the states with her. She has a document that her ex signed and is notarized stating the boys can leave the Ukraine. It looks like an official document but I don't know if there is a form or document number that I should look for. I have also heard that there can be an issue where the document is good enough for the Ukraine to allow the children to leave but not good enough for the US government.

Can someone that has good through this please provide some insight?

Also, I would like to adopt the two boys in the future, if I can their father will allow, any information on what I might need for this?

I also did two K-2s.

You need this letter for any children under age 16. There is no specific form needed BUT the letter MUST state that she can relocate the children PERMANENTLY to the UNITED STATES. In what form he says that is not important. If it is written in Russian or Ukrainian it no longer needs to be translated. It should be notarized AND you need a copy of the father's photo and signature page from his internal passport to go along with it.

Ukraine requires parental permission for one parent to leave the country for any reason with the children. It is not uncommon in divorce cases for one parent to give the other a letter allowing them to "leave Ukraine" but the intent is for a vacation etc. The US consulate WILL require that the letter specify that it is PERMANENT permission and that it is specifically for her to go to the United States, Permanently.

In the past, the word "permanent" has meant "indefinite permission" for women to leave and then return and leave again for visits, etc. It worked for us for three return trips for our youngest, and now he will be over age 16 before our next visit so it worked for us (you need this each time you visit and leave Ukraine, even after the child has a green card). At any rate, I strongly suggest that you make sure the letter is worded to not only allow her to get the visas but to expressly allow her to visit and leave again in the future. There have been some rumors of changes in the Ukrainian law regarding this. Nothing specific I can quote and maybe not even accurate BUT if you have to get the letter written anyway...why not? Hang on to the original letter, you WILL need it on return trips. We have had to show it each time when leaving Ukraine.

Adoption laws depend on states. Check your state laws for that.

Okay, thanks. I will ask her to send me a copy of the document or I will just view it while I am visiting and translate it to make sure it states that is for permanent relocation to the states.

As for adoption I will do some more research on this.

If she has not had intentions before to emigrate, in all likelihood it does not refer to permanent emigration to the USA

In addition to the absent parent letter, you will need a birth certificate from each. If they are under age 14 they do not have to go to the interview in Kiev, optional. In some consulates they do, but not Kiev. If under age 16 they do not need a police certificate. If it is a boy age 17 or older, he needs to fill out a form DS-157. ALL children need the medical exam. Boys over 18 need their military registration and deferrment papers, OR documents that they have served their military obligation.
