I have an approved K-3 Visa. Both the I-130 and the I-129 are approved and we are waiting for the interview at the consulate. I have 2 questions:

1. Which form will I need at or befor the interview, the I-864 or the I-134 or both; and is there any other form that should accompany these forms (in ref to the affidavits of support)

2. I moved to Costa Rica to be with my wife during this process and have not worked at all in the last year. We are living off of savings that is about gone. I have had a succesful Real Estate business and have also been employed as a fire fighter in Houston Texas for teh last five years. Will I have to have a sponsor since I quit working to be with my wife. I can return home and get rehired by the Fire dept. asap, but will that be enough since I haven't been employed this year.

05/12/2017 - NVC scheduled the interview!

You will get 2 letters from the consulate, the first one will have the medical forms in it and the second one will have the final instructions and the interview date. In our 1st package (P-3) the consulate told my wife to fill out the I-134 and DS-156. She took both of these in and had them checked. They then told her these were only for non-immigrant visa and told her to complete a DS-230 and I-864. The second package (P-4) very clearly identifies our visa as K-3 immigrant visa requiring DS-230 and I-864. So just wait for instructions, I am not sure if these long established rules are changing presently. I had to Fed Ex the I-864 to her at the last minute....

K visas whilst they are non-immigrant visas are processed in much the same way as immigrant visas. There is only one or two consulates that I have noted that give an option of using either the I-134 or the I-864. nakashima is correct in that the I-134 is for K-visas and the I-864 is for CR/IR-1 and also for adjustment of status once in the US. Consulates will and have always varied in its requirements to show that an applicant wont become a public charge and it is always best to be guided by others going through the same consulates. I am surprised however that you were told to submit an I-864 as well. Let us know once the interview is held how the added addition of the I-864 is handled by the conof.

Something is not clear at all - the K3 visa is not an immigrant visa. (But the K visas do require DS-230-I, and perhaps at some consulates DS-230-II as well.)

Chris and Mariana,

Point of clarification - you (or is it she?) do not have an approved K3 visa. Approved petitions are not visas, they are approval to apply for a visa.

1. With 2 approved petitions it's not entirely clear which visa your wife is pursuing (and I haven't checked to see if the necessary indicators are in your personal information) but the question as to which affidavit is appropriate has been answered. And yes, supporting information is required by both (see the form instructions) and for a K visa additional financial documentation beyond the I-134 is typically required.

2. The critical issue of support is the sponsor's current income situation, so it would be helpful for you to get back to work in advance of the visa interview and it will not necessarily hurt you that you took a sabatical - just be sure to show financial information going back several years to give a better indication of your income history than just the most recent year would show.
