Excessive wait time for process of RFE

Hello, I am concerned about how long it has taken for any response to my Request for Evidence (RFE) that I received from the California center of USCIS. On May 1, 2010 the USCIS received my petition for a K1 VISA. On August 5th I received from the USCIS a request for evidence. On August 10th the USCIS received my response. According to the USCIS case status Web page my response has been under review since it was received, August 10. On October 19,2010 I called the service center (1-800-375-5283) and spoke with someone who left me wondering if they even knew what a I-129F form was. As a result of that phone call I received an email telling me to expect a response in 30 days. That was October 19th...3 months ago.

My question is for advice on what to do next? Should I write a letter to the USCIS, using the California center address explaining and calling their attention to this dateline? Calling really does seem fruitless unless there is a better number to call. I would truly appreciate any advice/suggestions you might have. Thank you very much, Michael.

I would get on this and do it now. There is no way that this is a normal wait time. Your file got lost in the shuffle, and they need to find it.

The robots who answer the phone there are about as useless as screen doors in a submarine. I am not surprised the one you spoke to never heard of an I129f because all they know is the time their shift ends and where the exit door is. Call again and ask to speak to an immigration officer. If they resist, you insist. Tell them that there is a problem here, and you need somebody with authority to resolve it.

Thanks, I did call and was finally able to speak to an officer who at least realized there was some problem and is actually able to do something about it. Thanks again..Michael.

What did the IO say the problem was? I am in a similar situation, just waiting for a reply to my "Review of Response to RFE" which was sent in in August 2010. I am stuck in that bubble right now. Let's keep praying we get approved soon.

The officer told me that there was an 'intent to deny' issued on Aug. 17th. I explained I was totally unaware of this..officer says I should have gotten something in the mail. I was permitted to ask him (the officer) one question that he would forward to the California office in charge of my case. I asked him to ask them (this is already sounding a little ridiculous, no?) why I have not heard anything from the USCIS since they received my RFE on Aug. 10th. The officer told me that was not a question. Ok.....so the officer agreed to email the office asking why they had not sent me my intent to deny letter and to please do so. So now I am waiting for my intent to deny letter, whatever that is. But it doesn't sound good. Best wishes to you...Michael.

So, did you get that hard copy of their NOID yet? Is it something you can easily overcome?

I received the NOID today. The are asking me for more evidence (I have already provided photos, passport pages, itineraries of us traveling together, my itineraries....). They want things I have already provided plus phone/email records and credit card statements. I had previously applied for a K1 VISA with a different lady and they want an IMBRA waiver request, even though I submitted a waiver request with my original application. I can provide them with everything they have requested, but it is impossible for me to determine exactly what they want as direct communication is prohibited. So, I will send them what they want, although the IMBRA waiver request is pretty ambiguous. They offered no explanation as to why it took them since Aug. 10th to respond to me. I am beginning to believe they lost my stuff and that is why they are asking for it again...
