Ok so I think this may be a bit of a weird situation. My husband and I applied for out I-130 in July(!). Yah, we were part of the unfortunate bunch that got transferred to TSC and nothing has happened since, which has led me to my current predicament. When my husband and I applied, we thought it would only take 7 months max. During that time he was doing a seasonal job, then when the season turned cold he was laid off as he always was. We thought he would have time to get his visa and come live with me a find a job when he got here.

BUT since it's taken WAY too long he has found a pretty good job in his city, and it is a good move for him. I am not sure what to do. Do we keep going forward with his Visa? Can he keep his USA visa if he keeps his job in Canada? Can I apply for my Canadian visa while he's applying for his american one?

I wish it wasn't so stinking hard, we are only 6 hours away but the government makes it seem like a whole other world!!!

11/30/10: Touched! FINALLY

12/01/10: Touched, AGAIN!

02/14/11:I-130 Approved Happy Valentines Day!

NVC

02/18/11: Received NVC Case number

02/20/11: Optin email sent

02/22/11:Submitted DS-261 (Choice of Agent)

02/23/11: AOS invoiced and paid

02/25/11: AOS I-864 Emailed to NVC

03/02/11: IV Bill generated & Paid!

03/08/11: Optin Accepted

03/17/11: DS-260 completed

03/24/11: DS-260 Supporting Documents emailed

03/24/11: Emailed my I-864 AGAIN because NVC is saying they did not receive it.

04/08/11: NVC robot says they are "Awaiting my Biographic Data" which I assume means they reviewed my I-864

04/11/11: NVC is saying I am missing info, that I did not send in all my documents.

04.14.11: NVC is saying i never emailed anything. I contacted my senate office, who is getting things handled for me at NVC.

05.12.11: OMG SIF!

07.11.11-INTERVIEW DATE!

He will be able to keep his US visa for 6 months after it is issued. So say he gets interviewed in April and approved, he'd need to move over by October. You can apply for a Canadian visa- I wouldn't tell the US unless someone specifically asks.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, you can apply for your Canadian visa while he applies for one to the US. However, this doesn't solve your problem. You'll need to eventually pick a country to live in - additional expenses of another visa can add up.

Once he receives his visa, he needs to be a PR of the US. However, LOTS of people have had success of driving to Canada each day for work while living in the US. come over to the Canada forum for more detailed, regional answers

Remember, Canada is a whole different country and Candaians have not 'right' to live in the US. Even if you only live 6 hours apart.
