Yeah if the perp was standing still in the darkness!

you can still see a faint outline - but that's about the extent of the details one can see at that hour without any additional illumination.

yes, you can engage a target moving on foot at night with some measure of success.

If you can see a faint outline - you can also see them moving away from you. Sorry Charles - this guy apprears majorly "successful" if you want to go with the excuse that it was dark out and therefore couldnt see the perp therefore shot him a few more times. I don't buy it.

a brief search on the story - this occurred 1:30 a.m. on Nov. 24 - it was just past a full moon.

This so-called jogger went out looking for a kill, and got one. Bravo for him. What a brave man.

We're all assuming a lot here, kemosabe. The alleged assailant punched the guy in the face while the man was jogging in pitch darkness. He just came out of nowhere and decide he'd like to punch a guy in the face at night. Without any other witnesses, no one will know exactly what happened, but firing shooting at the guy 8 times seems more like retaliation than act of self defense. And while the jury found him innocent, it would be pretty difficult under the circumstances to find him guilty beyond reasonable doubt with the law that gives citizens permission to be vigilantes on the streets.

Hmm. Well Town & Country is pretty well lit - since it is a totally crappy part of town. I can't buy the darkness theory at all - knowing that.

Which begs the question why the jogger chose to jog in that area in the middle of the night. The whole story stinks to high heaven.
