I wish to cancel my husbands case. Besides emailing the embassy to let them know not to accept him for an interview if he dares to show up. Do I send a paper letter to the USCIS and NVC? Thanks

Sorry to hear things are going south. It is my understanding that you need to write to the embassy to withdraw your petition. You should follow up with a call to the Department of State to make sure things are in order.

It sounds like you've thought things through thoroughly if not, may I suggest you do so. You have certainly invested lots of time and effort... oh and money to get this far.

2009-12-17 - Case complete e-mail message, sign in failed on website and AVR... YAY!

2009-12-29 - Interview assigned: February 11, 2010!

Yes I know I have invested a lot. Could of bought a new Benz with all the money I spent. But YES 100% positive. Thanks Ill just send everyone a notorized letter.

Came here via "new content" - Sorry to hear, ghanagal, that things went bad :( But I've also been there (and done that), aborted my K1 visa application process. All I had to do was write a letter to the US consulate here in Malaysia, informing them that I did not wish to go through with the process. That's all I did, and things are okay. All the best to you!

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

Actually, no notarized letter required.

Just send a simple, one page explanation to USCIS, NVC and to the embassy.

Include all immigration numbers and identifiers of the beneficiary, and give a simple explanation of why you wish to abandon the petition. They don't care.

BTW, in the future, should you wish to try again and find true foreign love, just say in the letter that you wish this letter to be construed as an IMBRA Waiver, should such a waiver be required.

Keep in your records, and reference it in a future application, if needed.

ps, if you get the itch and find someone new right away, you dont need your previous case to be closed before you apply again (woo hoo!)

What Boing! said is correct - just a simple letter, without notarization. And yes, include all immigration numbers and identifiers and simple explanation. "They don't care" is a very good way of putting it :P They're probably happier. Ha.

:wow: sorry to hear this I know you were so happy that the case had been reaffirmed and sent back and had been assigned a new interview. So I trust you have thought through the whole thing and have come up with an answer that best fits you and your hubby. It is better you know now than later when maybe he was here. I believe in the Maya Angelou saying "when someone shows you who they are...believe them" ( I think your hubby was not cooperating and had expressed some apprehension sometime ago according to your post)GOD BLESS YOU It is probably best this way...stay strong Edited by patient2010

I feel your pain because I have been there before. You have been giving good advice. Send both a letter and an email to Embassy to let them know that you want to cancel your petition. Also write to USCIS to withdraw your petition.

Patient2010 said well ("It is better you know now than later when maybe he was here. I believe in the Maya Angelou saying "when someone shows you who they are...believe them")In my case, my wife made it all the way here in U.S. only to leave me after I have adjusted her status and after getting a CNA certificate in only 10 months with my money. It was a waist of time and a lot of money. Stay strong.
