I-130...what happens next

Timeline

I can't believe how much information is out there...because of that I'm becoming increasingly confused. My husband and I got married November 26, sent our petition I-130 Dec 24, received Dec 27, check cashed Jan 4 and NOA arrived Jan. 7. So now what? I was expecting some instruction or something with the NOA but it was just the receipt. Can anyone tell me what to expect and approximately when to expect it? I'm trying so hard to be patient but I have a feeling this waiting will end me! :wacko:

anyone with insight??

I'm not from Canada (love it there, though... I just found your post when looking for new content via the button), and it's not very clear what your situation is (are you the petitioner or the beneficiary? Are you on VWP? Did you have a fiancee visa? Are you filing from within Canada?), so it's hard to give very precise answers.

In general, you're right, you don't get much info from USCIS. If you're filing concurrently, you'll get receipts for each form. If you're just filing the 130, then you probably have everything you're going to get for a while.

Look at my timeline to get a sense of how things progressed. It took 50-ish days before anything showed up online (and it was only 1 of the 3 cases), and 80-ish days before we got our biometrics appointment. It was sooooo hard to wait...

08/12/10 - Day 0 - Mailed I-130, I-485, I-765 (USPS Express Mail)

08/13/10 - Day 1 - Delivery Confirmation at USCIS Chicago Lockbox

08/20/10 - Day 8 - Electronic (E-mail/SMS) confirmation of acceptance/NOA issued for I-130, I-485, I-765

10/09/10 - Day 58 - EAD (I-765) case visible online, others still not showing up.

10/21/10 - Day 70 - Spoke to 2nd-tier support, got a "referral" opened on the biometrics appointment (as in, why isn't there one yet?)

10/29/10 - Day 78 - Biometrics appt letter received (scheduled for November 18 in Alexandria)

11/04/10 - Day 84 - Successful Walk-In Biometrics at Alexandria, VA

11/04/10 - Day 84 - Email/SMS notice of "Card Production Ordered"

11/09/10 - Day 89 - Email/SMS notice of "Card Production Ordered" (same text, same everything, just a second notice)

11/12/10 - Day 92 - Email/SMS notice of "EAD Approved"

11/12/10 - Day 92 - Received EAD card in mail (same day as notification of approval, no other snail mail notices)

12/07/10 - Day 117 - AOS Interview letter received (scheduled for January 10, 2011)

01/10/11 - Day 153 - AOS Interview complete - verbally approved, but we're not believing it until the card shows up.

01/14/11 - Day 157 - Electronic (E-mail/SMS) notification of approval of I-485

01/15/11 - Day 158 - Received notice of I-485 approval in mail

01/18/11 - Day 161 - Received Green Card in mail!

Ok assuming that this is a regular i130 cr1 visa and not dcf (assuming you are filing from the states or he is lol).

You got your noa1 YAY congrats , you can sign up at uscis.gov for status updates on your case using the number on the noa1, please do not expect to see any movement as in some cases they never even update it till you get your noa-2 petition approved.Noa1 to noa2 takes around 5 months, just relax and try not to count the time. You will get an email when the Noa-2 is approved and a letter in the mail as well. From there your case will be sent to NVC which you will call and they will give you a case number, you will electronically (email) them all the documents ds320,police certificate, etc. Nvc usually takes 15-60 days on average, once all documents have been received you will get a case complete and an email saying that. Recently people have been receiving there "schedule your interview" within a few weeks and then your interview will usually be 1-3 months later.

thank you, and yes it is a regular I-130. We did not have a fiance visa we just sorta went ahead and got married...I guess we actually eloped. Our family doesn't know yet that we are actually married but think we are engaged. We are planning a marriage ceremony for April. We wanted to get a head start on the paperwork and the fiance visa would have locked me into the US for a number of months which we didn't want. Fortunately, we only live 15-20 min apart so we see each other basically everyday if we can. It really does make this process much easier than its been for many but the waiting is still not fun at all!

So its normal to not hear anything for months now? I'm also seeing more fees along the way....ones that we can afford but didn't notice before when we were looking over all the paperwork to come. Can you tell me what total cost i should expect when its all over? And also, to be clear, I'm not allowed to move until i get the final approval after the last interview, right? I'm looking at about 10 months or so aren't I?

Additional fees you will have to pay will be:

NVC: IV fee of $404 and AOS fee of $88.

Medical fee is $250 +

Miscellaneous fees for passport photos, travel and accommodation to Montreal for the interview.

thank you for the fee breakdown. That helps--only slightly confused now...I am immigrating to the US. Will I still be interviewing in Montreal? I guess I thought it would be a location somewhere in the US.

Yes it is normal to not hear anything for 5 months.

Yes you will be interviewing in Montreal,you will interview in Canada because you live in Canada. :)

Yes you must wait to move till you receive the visa from montreal and yes 9-12 months is a good approx timeline.

Yes you must wait to move till you receive the visa from montreal and yes 9-12 months is a good approx timeline.

well, I have always wanted to see Quebec. This is a trip we need to make together right? wish that were a trip we could plan ahead for. Do they give you much notice to book flights/hotel/etc?

He does not have to be there with you, My husband felt it was too long of a drive for him to come with me. It is all about what is comfortable for you.

They give you 4-12 week notice so enough time to make arrangements, also as mentioned before most people are scheduling their own dates through the online system now so you will be able to pick your own date(well sorta) lol.
