Hello all!!! If anyone knows please help..Filling out form I-864 requires to provide income for years 2007, 2008, 2009..my income in 2007 was not enought to meet 125% of poverty guidline..the rest was..does it matter or should i wait to file for 2010 income tax before filing for AOS.

Income that far back does not matter, what matters is current and future income.

Attach a letter from employer, and copies of recent 6 months pay-stubs.

You're required to write the income numbers for those years because you're declaring that you DID file a tax return those years. They won't deny you based on your 2007 income. They'll use your most recent tax return, and proof of current employment.

Hi, Our case might be different from yours as we're Dec '10 filers, so basically still new in the USCIS system. I had few concerns on our I-864 because I have my own business. Without the boring details, I called up my CPA for help. I thought I'd have to submit '07-09 tax transcripts, but because our interview for the K1 visa will most likely be after April 15th 2011 tax due date, he recommended that we give them 2008,09 and 10 instead.

From what you said, your 2007 was the one that did not meet 125% requirement and 2008-9 did. I would wait and turn in 2008,09 and 10 then. You can do taxes before April deadline, and have the copies of what you submitted to the IRS on hand (tax forms). I am not sure if the USCIS wants actual tax transcripts though. Electronic filing puts your 2010 into the IRS tax transcripts quickly (2-3 days), but if we mail them in, the IRS told me it was 90 days wait 'at earliest' until they are registered on our transcripts.

If USCIS want transcripts only, the IRS takes 30-45 days to mail them to you, but I think you might be able to d/l them online--- I'm not sure. *my experience with them only*

If the USCIS accepts our Tax Forms (copy of what we send in), then you'll be good to go. **Please note** Ask your CPA and also inquire at USCIS website if you do turn in copy of your 2010 filing, do you need to have the IRS purple stamp on it for proof that you actually did file 2010? That comes from physically dropping your filing in at your local IRS office; not mailing it in. ** I brought in 3 copies when I went there. One I turned into them and two with their stamp I kept for proof of file. (this was not for USCIS though)

Also, since part of the I-864 also requests current 2011 paystubs (three current mos.), and a letter from employer, you can show you are financially stable now when your AOS application is sent in.

Oh its 6 mos pay-stubs! Sheesh I stand corrected. I thought it was 3 mos. Sorry about that.

I ordered a transcript for last year's return before I even got my refund check, and the transcript arrived the day after the refund check arrived. That was about four weeks after I mailed in my return. It doesn't take 90 days after a paper filing before you can get a transcript.

You're talking about ordering copies of a filed tax return. That's not the same as a tax return transcript. A transcript is simply a computer printout of the numbers that were entered on the forms. You can order tax transcripts at no cost over the phone, and you'll get them within two weeks. If the agent isn't busy they'll even fax them to you the same day.

I had to file a paper return last year. I couldn't file electronically because it was the first year I was filing jointly with my new wife, and she (obviously) didn't have an AGI number from the previous year that could be used as a PIN for electronic filing. Jim, so the transcripts are our AGI numbers from previous years.... I had to wait 90 long days because I was waiting on 2007 amended filing & corrections on the AGI. This was for mtg co, totally different use than the USCIS. But good to know they don't take that long to get. Do you know if we have to submit these transcripts with copy of our tax return? Or is it just the tax returns for 3 years and current pay-stubs/ letter from employer.

LOL this is why I had to have my CPA do mine... I can't count. LOL :lol:
