Yes, as long as he presents marriage cert to POE officer and points out that 2 years of marriage has past before entry to the USA, the POE officer should code the resulting green-card as UN-Conditional and it should be valid for 10 years, not 2.

I have seen some get the 2 year card even though qualified for 10 year, if this happens simply schedule an info pass appointment to USCIS, bring evidence that have been married more than 2 years at entry, easy enough, (passport with entry stamp, green-card with "resident since", and marriage certificate) should do.

Agree 100% with the above post, make sure she brings the marriage certificate handy and make it clear to the officer that you've been married for more than 2 years.

same here we file cr1 then i have my visa IR1 because it reach to 2 years :D

yup - totally do-able, but assume nothing is automatic - she must 'bring it to the attention of the CBP officer'.

i agree on you i willl bring all the documents needed i wont forget the marriage contract just incase better to be prepared.. because soon i will be flying in USA from cr1 to IR1 :D:D

on my port of entry the officer told me that he upgraded me from CR1 to IR1 because he sees that im married for 5 years but now i just received my green card and my category is still CR1. what can i do about it? pls. help. who can i call or something?

I would call my local immigration office and go from there. I am sure either they will be able to help you or direct you to the right area to get this solved.

I am in the same boat... my wifes category was upgraded to IRI at airport, but received CRI instead... sent back wrong green card with proofs and explaination, in december 2010.

in april she had fingerprints done and as of today case is in initial review stage. my receipt number starts with LIN .. means its with nebraska service center, and according to timeline what uscis states the case is taking 3.5 months. i dont know what gives.in general its been almost 7 months... double time what they advertise.

Hi everyone... My spouse came in two days after our second anniversary. The passport was stamp, with a written IR1 on it.. couple of days after that we received a receipt letter from USCIS that they had received the petition and then days after we received a "Welcome to the USA" letter and then another "Welcome to the USA" letter with a different date on it. we also received the green card but it still indicated as CR1 and will expire in two years. Does anyone share the same experiences and what is the best way to correct this? Many thanks..
