hello

I am in america with K1 status now. it has been for 2 months since i entered USA with K1. i found that things will not work out. so I start to think about going back to my country (Japan) in 90 days come.

i have read that if i leave USA before 90 days come, my status is automatically expired.

I am wondering if i need to fill out some papers to hand in for cancelation of marriage? and if i will be out-of status aline if i leave USA in 90days without informing to USCIS?

it is very hard to make decision since i have been with my fiance for 10 years.(we had long distance relationship)

Please advise

Nothing needs to be done other than make sure you turn in the I-94 card at the airport when leaving the USA prior to it's expiration.

Is now a US Citizen immigration completed Jan 12, 2012.

hello

the section in bold above is confusing...have you married since entering the US on the k-1? If not, then leaving the country before the 90 day period allotted on you I-94 is the proper procedure...

I'm sorry to hear that things didn't work out after you guys having worked so hard for the visa and your entrance to the US :( And after a ten-year relationship, too. My sympathies are with you both because breakups suck, no matter who breaks up with who. (I myself cancelled the K1 visa application process after getting NOA2).

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

I *think* she might mean letting USCIS know that she no longer plans to marry him 'cause she keeps calling him her fiance still (though really some people do that when we know they're married :P)...

OP - as Minya said, unless you're married (in which case you need to get divorced) you can just leave the US (make sure to hand over your I-94, and the process is over for you.

As long as you do so within 90 days of your arrival, yes.
