Please Help with I-130 Question

Timeline

Hi everyone Well this is it-My first official Question for our Visa Journey. How would I answer Question #22 on the I-130 Form. It would seem that because my wife is not in the United States that this question would not apply to her and I would simply write N/A. But in the instructions I have from "***removed***" it states that their is an exception for K3/K4 applicants. It says to write: "Plan to obtain a K-3 visa abroad and adjust status in the U.S.". Fill in the city you plan to adjust status and write the consulate you will return to if needed. :help: If this is the case what city would we plan to adjust status in and what consulate would we return to if needed. I am from wWisconsin and thats where Marie will be living also after coming here on a K-3 Visa. She lives in the Philippines right now. Oh yeah and also-another quick question. :whistle: On question #17 it says to List Husband/Wife and and all children of your relative. I put my name down of coarse because I am my relatives Husband, but my question is would I write my daughters name also. She is from a previous relationship (not marriage) and lives with me full time. She is in fact now Maries stepdaughter, so would she be Maries child in the eyes of the immigration office or should I just leave my daughters name out of it to keep the form as simple as possible. :unsure: Thanks everyone ahead of time-God Bless-Gary-I will start my timeline soon :star:

Sep-03-2005 - Met Online,spent hours every night on Yahoo Messenger for weeks on end. Falling in Love

Jan-10-2006 - First trip to the Philippines(14 Days) to meet Marie. Our Love is confirmed.

Jan-14-2006 - Asked Marie to Marry me. She said Yes- the next 10 days were heaven

Jan-24-2006 - Had to go back the the U.S. Wasnt a good day.

Aug-01-2006 - Second Trip to see Marie.

Aug-15-2006 - We got married, It feels so right!

Aug-24-2006 - Back home to the U.S. Again. Leaving this time was by far worse than the last.

Sep-03-2006 - 1 year since Marie and I met online

Sep-05-2006 - I-130 sent to Nebraska - Thanks to the help of the forum our Journey begins

Sep-18-2006 - NOA1 for the I-130 received in mail

Sep-27-2006 - I-129F sent to Chicago

Oct-04-2006 - NOA1 for the I-129F Received in mail

Oct-12-2006 - Email from USCIS - I129F transferred to California Service Center on Oct. 11th

Oct-18-2006 - Email from California saying they received my I-129F for processing

Nov-02-2006 - Email from CRIS(early afternoon) -I129F approved

Nov-02-2006 - Email from CRIS (late at night) - I130 approved

Nov-06-2006 - I129F and I130 NOA2 received in mail-Hooray!!!

The I-130 whilst it is necessary to be filed in order to file the I-129F petition for the K-3 visa, is also a path of its own as it is a path to the CR-1 visa. Follow the example form given here on VJ and put the city and country of consulate in the second section of question 22. At this early stage you really do not want to lessen your options as anything can happen during these processes. That can be handled at a later date.

Your first part was answered by Aussie. I will answer your 2nd question about Question # 17. Yes, you are her husband, so you put your name down there. You will list only her child(ren), if she has any. You don't list your daughter.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

We just send our 1-130 last week and searched and searched for the q. 22 and did not find; i was confused by the word " if the spouse is not eligible,"...then second part mentionning the consulate...I was scratching my head for 2 days...trying to understand what they meant...then i found the Instructions of the I-130, somewhere they explain that form is to determine the eligibility of the spouse...then well to put the story short, we finally put: N/A- in the part: spouse is not in the US, and for the 2nd part we put see sheet attached and wrote on it: that we did not understood the 1st part of the 2nd phrase of q.22 but we understand that the form is an application to determine the eligibility and if it was to a consulate, we precised the city...

Overall, if we are confused, maybe it's because it does not apply to our case...except the consulate question...not ther est...then i discovered the wavers forum with difficult stories of people who have overstayed, etc...and then i thought maybe this question is for this type of cases...Don't know but this is what we wrote...

If anyone has more deeper understanding of sometimes such confusing questions...

25 Aug 06 - Sent I-130 (a Friday)

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.
