How long till we can get a SS#

Timeline

We have submitted my husband packet for an AOS and part of that was also for the EAD (I-765) all that was submitted and received by the USCIS on 11/30/10 but then transfered to the California Service Center on 12/22/10. We received a ASC (bio appointment)which is scheduled for 1/25/11 at the Oxnard application support center.

Now we are wondering how long it will take before we can get the actual EAD and then will we still have to put in a separate request to get a social security number?

How long does this part of the process take?

There has been some job opportunities that have pasted by but we are not sure when getting a job will even be possible. In the past when we thought about hiring a lawyer a few layers told us we should be able to get everything taken care of to start working in 30 day?!?!?! Was this just something they told us to try to sell there business or are we missing something. Whatever it is we are hoping this part of the process is getting close to an end.

Also will I(a US citizen)be able to claim my spouse (currently Canadian immigrant) as a dependent for last years taxes since as of last year we are now a married couple and I have been supporting him?

I know this whole process is a waiting game but please help enlighten us.

Timeline

Typically SSA will issue a SSN a couple weeks after getting Green-Card or EAD card, it takes a couple weeks for USCIS to update database used by SSA to confirm immigrations status.

Lawyers just want your money. Many of them are not informed properly or say things to hook you in thinking they will be faster than what the reality is.

If he came in on a K-1 he could of gotten his SSN 2 weeks after entering, before marriage or after - as long as the I-94 was still valid.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You dont claim a spouse as a dependent, you file a joint return, if you don't have SSN you can file for an ITIN from IRS.

How long does this part of the process take?

Yes, he will need to submit an application at an SSA office once he either has an EAD card (Form I-766) or I-551 card (Green Card) or stamp.

The amount of time to be assign the SSN is going to depend on how long the SSA office takes to verify his immigration status. If you are lucky they will be able to do it while at the office. Otherwise it could take a week or more. Once the application has been cleared, the card should arrive in the mail within two weeks, but you can go back to the office the next day to obtain the number before the card arrives in the mail.
