If the most recent tax return is quite below the 125% poverty guideline but current income is $3,000+ above the line, could the AOS be denied?

Can always hold it until after filing 2010 return, if 2010 income was above the line as well as 2011 looking to also exceed 125%.

As long as you provided pay stubs and a letter from your employer proving that your current income exceeds the levels, you'll be fine.
