I have a quick question.. Does anyone know how many times you can apply using the Fiance Visa I129F? It is with the same person.. Very quickly, we filed and were approved in 2009, interview 2010 with a 221(g), case closed due to expiration.. Reapplied June 3, 2010, received NOA1 and were denied NOA2 (due to not answering questions the way USCIS accepted).. It is a LONG, LONG story with many twists and turns (with Immigration here and abroad).. I was wondering can I apply WITH THE SAME PERSON using the Fiance Visa a 3rd time? I have not seen where there is a limit and I know I will need a Waiver, but anyone have any thoughts they are much appreciated.. Thank you all very much!

If USCIS closed second petition not Revoked it, then I see no reason for a third try. Also if same person I don't think a waiver would be needed either, IMBRA, ahs to do with petitions for several different people over a period of time.

If it were me, I would forget the K-1, go see my fiancee, marry, and then apply for a CR-1 spouse visa, much less cost in fees (~ $800, vs ~1800), and probably a better chance of getting the visa. Also wont be dealing with USCIS to adjust status, CR-1 gets green-card upon arrival to the USA.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

I agree with the other member's suggestion. Why not go ahead and get married and file the I-130 instead? It is cheaper than the K1 and when the fiance(e) enters the US he/she will enter as a permanent resident.

Best wishes!
