Do K-1 filers need to submit anything to NVC?

Hi Everyone,

I apologize in advance if I missed this info somewhere on here, but I would appreciate it so much if one of you VJ experts could clarify some NVC details :-)

Our paperwork is currently en route to the NVC (received NOA2 email on 1/5/11).

Do we need to submit anything to NVC?

Or is the next step bringing all the required paperwork to the interview?

If so, am I just waiting for an interview date at this point?

Does that come with the paperwork that will be sent to my fiancee in country? (I can also find out by calling NVC, is that right?)

You don't need to submit anything to the NVC--it's usually just a quick pit-stop before they forward your case to the appropriate consulate. Your next step is waiting for packet 3! You'll submit everything they ask for in packet 3 and then you'll receive packet 4, which will contain your interview date.

Yeah ditto as Jess and Andrew said NVC is a stop over and to create a case number which will then be forwarded on to beneficiaries consulate/embassy. Just hang in there for a week or so and you will hear something as in packet 3.

Nope, NVC is just a weighstation for the case to get a DOS case number and then gets sent to the consulate.

Nothing needed to do with NVC from petitioner or beneficiary.

Confirmed. The only direct interaction K-1 couples have with the NVC is that the NVC will send the petitioner a letter once they receive the approved petition, stating that they're about to send the approved petition to the US consulate. They tell you which consulate they're sending it to [which might be news to you if you accidentally put the wrong consulate on your I-129F. Don't worry if you did that - NVC sort it out quite easily], give you contact info for the consulate, and give you your consulate case number. The consulate, depending on their procedures, will send the beneficiary a packet 3 a few weeks later, after they receive the approved petition.

Except for this letter, K-1 couples never even know that the NVC exists, for all that they interact with it. It's almost completely transparent from their point of view.

Wow, there is a lot of great information on this post. I always wondered why the K-1 filers flew through the NVC :)

K-1 is considered to be Non-immigrant, so nothing to do at NVC like an immigrant visa.

K-1 will later have to provide a lot of this when adjusting status in the states.

As for packets 3 & 4. I am worried they will never get to my fiance's house in the rural DR (mail does not get delivered there.) Is there any way I can get my hands on a copy sent to me here in the US? Or other suggestions for people who have been in similar situations?

I'm not positive, but it may depend on your consulate. We went through Montreal, QC and I (the US Citizen) received a copy of both packets 3 and 4. It might be worth checking out the Latin America/Mexico/Caribbean forums and asking there. Good luck!

Some consulates put all of their Packet 3 info and forms online. Some consulates do that and don't even send out a paper Packet 3.

Congrats on your NOA2. The consulate in Santo Domingo only sends Packet 4 (there is no Packet 3).

They will send the Packet 4 soon (with instructions on what to do before the interview). The instructions will be very similar to the Instructions posted on the site.

After you receive your NOA2 (approving your I-129f petition), you will receive a letter from the NVC telling you that they are processing your case and it will mailed to the appropriate Embassy. During this time your case is examined then repackaged and mailed to the Embassy handling your case.

To get valid information just wait 1-2 weeks and call (toll-free) the Visa Specialist (Department of State) in Washington D.C. Call 202 663 1225. Press Option 1 then Option 0 to speak to a visa specialist. (Do not waste your money calling the Embassy). They will tell you when your case was mailed and when your interview date is.

Also keep checking the Interview list (Currently they have January posted) to see when your interview is. Just type in the Case # that was printed on your NVC Notice (SDO2010...)

Your packet will be mailed by the mail service in Dominican Republic (Inposdom). Which may take forever. Just keep calling and checking the interview list. So people never receive it, so be proactive. If you have not received anything around 2 weeks before your interview, call the Embassy and schedule a day to pick it up before your interview. The medical cannot be done if you do not receive your appointment letter that comes inside of Packet 4. Also, there is no way to track your case online at this point. So calling and checking the interview list is your best options.

You should have put as his address an address to which mail could be delivered. It will be important for him to be able to receive mail. If approved, his passport and visa will be mailed to him! You can check out the American consulate website at Santo Domingo to see the contents of the packet he would receive, but he would still need to be able to get those papers to be able to get his medical exam completed.

Congrats on your NOA2. The consulate in Santo Domingo only sends Packet 4 (there is no Packet 3).

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
