Hi,

I was reading the requirements for filing the I-130 for my wife (whom I recently married). It said that I should provide them with the affadivit sworn and sign by third parties proving that they have knowledge of our marriage. Does anybody have format I can use and follow?

Should I use somebody who is a US citizen?

I am already planning to use my mother (who is a US citizen) and her father. Do I need more?

Should I also include photographs of my mother and her father as well as any third party showing that they attended the ceremony?

My advise is that you think of anything on the list that follows the words "In addition to the required" as simply NOT required. Sending affidavits is about knowledge of the relationship, not verifying whether you got married. If you want to include some evidence of a genuine relationship, use the last category on the list, "other". Then, include some photos together from each of your visits and some examples of how and how frequently you communicate. Skip the affidavits. Unless the people have observed your relationship closely, they'll be useless and lame, so far more trouble than their non-worth.

3. My address is [TOWN, COUNTY, COUNTRY].

4. [NAME], the beneficiary, is my daughter.

5. [WHEN THRID PARTY FIRST MET / BECAMAE AWARE OF RELATIONSHIP OF PETITIONER AND BENEFICARY]

For the I-130 Petition all you need to prove (regarding the marriage) is the existence of a petition-able relationship between the petitioner & beneficiary, nothing more.

To prove this a certified copy of the marriage certificate will suffice.

Bona fides may come into question at interview time or Removal of Conditions.

The other things you need to prove are:

Identity of Beneficiary, Identity of Petitioner, USC or LPR Status of Petitioner.

I just had my mother and father write a note and then sign and date.

We were married Ministry of Justice. There was no ceremony just a signing of document with witnesses.

I also had pictures of us signing the marriage documents.

I'm not sure if I need more proof. US embassy said this is the only way they recognize marriage is by a Ministry of Justice.

When my wife comes to America we will redo our vows in Orthodox church.
