Plan is to petition for my gf under K1 visa this month. If I am so lucky to get through the grueling process before the end of the year and then quickly marry upon arrival, will I be able to file taxes for 2011 as "married filing jointly," or is there some long process to get a SS card once she gets here? I vaguely remember something about an ITIN when I petitioned for my now ex-wife 15+ years ago... but I think she got that because she was already actually in the US. Any thoughts on whether I'll be able to file as married as long as she gets the visa and we marry before Dec 31, 2011?

Yes, if you marry on or before December 31, you'll be able to file joint taxes. If she's in the US after entering on a K1 and then marrying, she'll not longer be eligible for an ITIN. She'll be eligible for an SSN at that point.

an SSN is not what determines whether one files jointly or not. What determines whether you can file jointly is the MARITAL status of the taxpayer(s) as of the last day of the tax year

Not a K-1 visa process question... moving thread

YMMV
