Hello!

I am adjusting from an F1 visa and was on OPT before my husband and I applied. Unfortunately I probably am not going to get my EAD before my current card expires. I was wondering though if anyone had any insight into whether I could renew my driver's license while my AOS is pending. Also can we file taxes together seeing that I was on F1 status for the year? Thanks!

I don't know if you can renew your DL before it expires; as you know, drivers licenses fall under State (not Federal) law, so they all brew their own cup of tea. Frankly, the odds are against you.

If you got married on or before December 31, 2010 then, yes, you can and should file a joint tax return as a married couple.

If you married before December, yes you can file a Joint IRS return.

As for DL, do you have an I-94, and how long is the card valid, if has 1 year or more, many State DMV will accept that as legal presence.

When did you get married and when did you apply for AOS?Once you get your EAD, you may go ahead and apply for your DL renewal.

If you married before December, yes you can file a Joint IRS return.

We got married last year. Good to know.

My card says D/S. I was wondering if I could bring my AOS paperwork and the I-94. I'm just going to call the DMV tomorrow and find out for certain. Thanks again!

We filed in October. My current F1 EAD card and DL are both set to expire this Saturday. I haven't gotten my new EAD card yet.

Most states require proof of legal presence in US when you apply for a new/renewal DL. That means a valid visa or EAD card or GC. The AOS receipt notices are not proof of legal presence, however I believe CA DMVs still accept them. It really depends on the state where you reside in.
